§ 5.01.010. Authority to enact.

This chapter is enacted pursuant to the authority contained in Article IV, Section 19 of the Constitution of the state of California and Section 326.5 of the Penal Code of the state of California.

§ 5.01.020. License required.

It is unlawful to conduct or play a game of bingo as defined in Section 326.5 of the Penal Code in the city of La Cañada Flintridge except pursuant to a license issued for the game pursuant to this chapter.

§ 5.01.030. Authority to issue licenses and prescribe rules and regulations.

The office of the city manager shall have the authority, pursuant to this chapter and applicable state law, to issue licenses for games of bingo by organizations exempt from the payment of the bank and corporation tax by Section 23701(a), (b), (d), (e), (f), (g), and (l) of the Revenue and Taxation Code and by senior citizens organizations. The office of the city manager shall enforce the provisions of this chapter and shall have authority to promulgate and administer rules to implement the regulation of bingo in the city of La Cañada Flintridge; such rules shall be submitted to and approved by the La Cañada Flintridge city council.

§ 5.01.040. Application for license.

A. Eligible organizations desiring to conduct bingo game activities must complete a bingo license application for approval by the city along with the application fee in an amount adopted by city council resolution. The bingo license application shall be filed with the administration department. Upon receipt, the office of the city manager shall review the application to determine this chapter and Section 326.5 of the California Penal Code have been or will be complied with. The applicant shall provide any additional information which may be requested during the review period, and as may be necessary to make a licensing determination.

B. A bingo license shall be valid for a period of one year.

§ 5.01.050. Regulation of games.

A. All bingo games and all activities in connection therewith shall be conducted in accordance with the provisions of Section 326.5 of the Penal Code of the state of California, as amended.

B. Bingo games may be conducted for no more than six hours within a 24 hour period, and may not be played during the hours of 2:00 a.m. – 10:00 a.m.
