1.04.010 - Title.

The title of this code is "Ordinance Code of Kern County."

1.04.020 - Scope.

A. All existing ordinances of Kern County are codified in this code as recompiled and recodified except (a) those calling or regulating the conduct of elections, (b) those granting, altering or revoking franchises, (c) some levying taxes, assessments or use charges, including those in county service areas, (d) some regulating subdivisions of land, zoning and performance of certain engineering functions relating to subdivisions, (e) those containing provision for invalidation, inactivation or repeal of entire ordinances upon a date or event occurring prior to the applicable recodification and recompilation, including some relating to interim zoning and to sewage disposal regulations in county service areas, to abandonment of subdivided land formerly treated as park land, to qualifications for the office of county auditor, to cost-of-living allowances for retirees and to establishing compensation by resolutions instead of ordinances, (f) those undertaking to regulate exercise by the board of its powers to enact ordinances in series, (g) most adopting land use zones and zone maps, and (h) some relating to charitable organizations and solicitations.

B. Notwithstanding the provisions of subsection A of this section, the only portion of Ordinance A-24 of this county not included in this code is Part 2 of said Ordinance A-24, as amended.

1.04.030 - Effect on existing law.

The provisions of this code, so far as they are substantially the same as existing law, shall be considered as continuations thereof and not as new enactments.

1.04.040 - Effect on existing rights.

No action or proceedings commenced before this code takes effect, and no rights accrued, shall be affected by the provisions of this code.

1.04.050 - Shall and may.

Wherever used in this code, "shall" is mandatory, and "may" is permissive.

1.04.060 - Definitions—Use of tense, number and gender.

Sections 12, 13, 14 and 1645 of the Civil Code of the State of California are incorporated in this section as if fully set out.

1.04.070 - Repeals.

No ordinance provision is continued in force because it is consistent with this code, but in all subjects provided for by this code all existing ordinances of this county, whether consistent or not with the provisions of this code, are repealed and abrogated, unless they are expressly continued in force by it. This repeal or abrogation does not revive any former law heretofore repealed, nor does it affect any right already existing or accrued, or any action or proceeding already taken, except as in this code provided. This repeal or abrogation does not affect ordinances excepted by subsection A of Section 1.04.020.

1.04.080 - Constitutionality.

If any chapter, section, subsection, sentence, clause or phrase of this code is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this code. The board of supervisors of the county of Kern hereby declares that it would have passed this code and each chapter, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more of said chapters, sections, subsections, sentences, clauses or phrases might be held invalid.
