4.28.010 - Purpose

The city council finds and declares that the unregulated operation of the special event as defined below tends to generate unacceptable levels of light and noise, and results in the congregation of people and traffic requiring the added commitment of police resources, all to the detriment of public safety and welfare.

4.28.020 - Definition

Special event means a temporary, organized, outdoor program of entertainment or exhibition such as a carnival, amusement ride, circus, live animal show, fair, flea market, rodeo or similar use, where activities include such things as rides, exhibits, food or beverage services, sales or small-scale games. "Special event" does not include a private event on public or private property.

4.28.030 - Permit required

Any person or entity operating a special event, whether on private public property, shall first obtain a permit for the operation of said event from the city manager, by providing the information requested by the city manager and submitting a completed city application form. The permit shall be valid for no longer than three days unless approved by the city manager in which case the reasonable cost of extra city services (e.g. police patrols) provided in order to assure the public's safety and welfare may be assessed as an additional fee.

4.28.040 - Exception

No permit is required for a special event of less than 24 hours' duration that does not include amusement rides and is sponsored by the city, schools, churches, or nonprofit organizations. This provision is not intended to waive any other city approval requirements.

4.28.050 - Conditions

Reasonable conditions may be imposed on the permit in order to address such things as crowd control and supervision, safety, noise, hours of operation, and the avoidance of adverse impacts on nearby property. The permit shall contain insurance and indemnification provisions adequately protecting the city which shall be approved by the city attorney.

4.28.060 - Permit revocation

A permit may be revoked by the city manager if:

(1) The permittee fails to comply with the conditions of the permit; or

(2) The event causes excessive noise, congestion, or other disturbance of the peace despite the permittee's compliance with the permit conditions.

A permittee shall be given notice and an opportunity to respond before the revocation takes effect.

4.28.070 - Permit fee

The applicant for a special event permit shall make an initial payment of $50.00 at the time the special event permit is requested. City staff shall charge for its actual time in preparing and issuing the permit at the rate of $125.00 per hour. City staff shall issue a rebate if the cost for its time is less than $50.00 and an invoice for the balance if the cost is more than $50.00.
