§ 8.04.010. Declarations.

Pursuant to Section 17122 of the Agricultural Code of the state, the county board of supervisors declares that except for the exceptions stated in this chapter, the county is a county devoted chiefly to grazing and that the provisions of Section 17122 of the Agricultural Code of the state apply under the provisions of Section 17122 of the above entitled code, and by this chapter no person shall have the right to take up any stray animal found on his premises or upon any premises to which he has the right of possession; nor, shall the person have a lien on any such animal unless the premises in question are entirely closed with a good and substantial fence. This declaration applies to any and all lands within the boundaries of the county with the exceptions stated in Section 8.04.020.

§ 8.04.020. Exceptions.

The following described lands within the boundaries of the county are specifically excepted from the above provisions and the lands are declared to be not devoted chiefly to grazing:

A. All lands within the boundaries of the city of Bishop;

B. All the following lands within the town of Big Pine described as follows:

Beginning at the section corner common to Section 17, 18, 19 and 20, T. 9 S., R. 34 E., M. D. M., and running thence east along the county road 312 feet, thence north and parallel to the centerline of the state highway to the south line of Block 93 in the town of Big Pine, thence east along the south line of said Block 93, 318 feet more or less to the southeast corner of said Block 93, thence north and parallel to the centerline of the state highway, to Crocker Street as shown on the map of the Given Addition to the town of Big Pine, thence east along Crocker Street to the southeast corner of Block 20 of the Given Addition, thence north along the east line of Blocks 20, 19 and 18 of the Given Addition to the northeast corner of said Block 18, thence west along the north line of said Block 18, to the west line of Washington Street as shown on the map of the Given Addition, thence north along the west line of Washington Street to the state highway leading to Goldfield, thence west along said highway to the section corner common to Sections 7, 8, 17 and 18, said township and range, thence north along the section line 312 feet, thence west 418.65 feet, thence south to the northwest corner of Lot 1, Block 37 of the town of Big Pine, thence south along the west line of said Block 37 to the southwest corner of said Block 37, thence west along the north line of Block 48 to School Street, thence along a line bisecting Blocks 45 and 46 to the west line of Block 45, said blocks being in the town of Big Pine, thence south along the west line of Blocks 45, 60 and 65 of the town of Big Pine to Crocker Street, thence west along Crocker Street four hundred feet, thence south along the west line of Lots 10 and 11 in Block 72 of the town of Big Pine to Cornell Street, thence east along the north line of Cornell Street 95 feet, thence south to the south line of Block 73 of the town of Big Pine, thence east to a point 208.8 feet from the west line of West Street of the town of Big Pine, thence south and parallel to the centerline of West Street 528 feet more or less to the north line of Block 85, thence east along the north line of Blocks 85, 84 and 83 of the town of Big Pine to the northwest corner of Lot 1 of said Block 83, thence south and parallel to the centerline of School Street to the south line of the town of Big Pine, thence east along the south line of the town of Big Pine to the point of beginning;

C. All of the following lands within the town of Independence, described as follows:

Beginning at the northwest corner of the town of Independence, said point being marked by an iron pin, and being the point of intersection of the west line of Grant Street and the north line of Inyo Street, said streets being streets in the town of Independence, running thence N. 26 degrees 34 minutes W., 1500 feet to a point, thence N. 63 degrees 26 minutes E., 1980 feet to a point, thence S. 26 degrees 34 minutes E., 1500 feet to the north line of Inyo Street, thence N. 63 degrees 26 minutes E., to the northwest corner of Block 10 of the Owens Valley Improvement Company's Subdivision of the Robinson Ranch, thence N. 89 degrees 43 minutes E., 515.7 feet to the northeast corner of said Block 10, thence southeast along the east line of Blocks 10, 12, 21, 18 and 32 of said subdivision to Citrus Avenue, thence S. 89 degrees 40 minutes W., along Citrus Avenue to the southwest corner of the town of Independence, said point being marked by an iron pin, said pin being S. 88 degrees 27 minutes E., from the corner common to Sections 17, 18, 19 and 20 T. 13 S., R. 35 E., M. D. M., thence N. 26 degrees 34 minutes W., along the west boundary of the town of Independence, to the northwest corner of said town, the place of beginning;

D. All the following lands within the town of Lone Pine, described as follows:

Beginning at the quarter section corner common to Sections 27 and 28, T. 15 S., R. 36 E., M. D. M. and running thence east along the quarter section line to the southeast corner of the Lake View Addition to the town of Lone Pine, a distance of 420 feet more or less, thence north along the east boundary of the Lake View Addition to the town of Lone Pine 1050 feet more or less to the northeast corner of said Lake View Addition, thence west along the north line of said Lake View Addition 420 feet to the section line common to said Sections 27 and 28, thence north along said section line to the section corner common to Sections 21, 22, 27 and 28, said township and range, thence west along the section line common to Sections 21 and 28, 1320 feet more or less to the east line of the Edwards Addition to the town of Lone Pine, thence north along the east line of Edwards Addition 2608 feet more or less to the "Depot Road," thence west along the south line of Depot Road to the west line of Edwards Addition to the town of Lone Pine, thence south along the west line of Edwards Addition to the north line of Court Street in the town of Lone Pine, thence S. 68 degrees 08 minutes W., 640 feet to the northwest corner of the town of Lone Pine, thence S. 21 degrees 52 minutes E. 556 feet to the northeast corner of the one time proposed Leete and Meyers Addition to the town of Lone Pine, thence S. 69 degrees 45 minutes W., 1683 feet more or less to the northwest corner of the proposed Leete and Meyers Addition, thence S. 1 degree 07 minutes W., along the quarter section line to the east and west quarter section line of said Section 28, thence east along said quarter section line to the point of beginning;

E. All the following lands within the Keeler area, described as follows:

Beginning at the southeast corner of the town of Keeler as shown on the official map on file in the office of the county recorder, said corner designated as Corner No. 1; thence N. 36 degrees 47 minutes E., a distance of 1500 feet more or less along the easterly town boundary line to the intersection of the southerly right-of-way line of the state highway, IX-INY-127-C, said point of intersection shown on the plans of the State Department of Public Works, Division of Highways, dated September 16, 1949; thence along the southerly right-of-way line of the state highway 1855 feet more or less to the intersection of the northerly town boundary line of the town of Keeler; thence N. 53 degrees 13 minutes W., a distance of 1079 feet more or less along the northerly town boundary line to the northwest corner of the town of Keeler, said corner designated as Corner No. 4., thence S. 36 degrees 47 minutes W., a distance of 1820 feet more or less along the westerly town boundary line to the southwest corner of the town of Keeler, said corner designated as Corner No. 3; thence S. 53 degrees 13 minutes E., a distance of 2690 feet more or less to the point of beginning;

F. All the following lands within the Tecopa Heights area, described as follows:

Beginning at the section corner common to Sections 10, 11, 14, and 15, T. 20 N., R. 7 E., S. B. B. & M; thence northerly 2640 feet more or less along the section line common to said Sections 10 and 11 to the northeast corner of the southeast quarter of said Section 10; thence westerly 3960 feet more or less to the northwest corner of the northeast quarter of the southwest quarter of said Section 10; thence southerly 660 feet more or less to the southwest corner of the northwest quarter of the northeast quarter of the southwest quarter of said Section 10; thence easterly 660 feet more or less to the southeast corner of the northwest quarter of the northeast quarter of the southwest quarter of said Section 10; thence southerly 1980 feet more or less to the southwest corner of the southeast quarter of the southeast quarter of the southwest quarter of said Section 10; thence easterly 3300 feet more or less along the section line common to said Sections 10 and 15, to the point of beginning;

G. All the following lands within the Tecopa Hot Springs area, described as follows:

Beginning at the section corner common to Sections 33 and 34, T. 21 N., R. 7 E., and Sections 3 and 4 T. 20 N., R. 7 E., S. B. B. & M.; thence northerly 2640 feet more or less along the section line common to Sections 33 and 34, T. 21 N., R. 7 E., S. B. B. & M. to the northeast corner of the southeast quarter of said Section 33; thence westerly 3960 feet more or less to the northwest corner of the northeast quarter of the southwest quarter of said Section 33; thence southerly 2640 feet more or less to the southwest corner of the southeast quarter of the southwest quarter of said Section 33; thence continuing southerly 1320 feet more or less to the southwest corner of the northeast quarter of the northwest quarter of Section 4, T. 20 N., R 7 E., S. B. B. & M.; thence easterly 3960 feet more or less to the southeast corner of the northeast quarter of the northeast quarter of said Section 4; thence northerly 1320 feet more or less along the easterly boundary line of said Section 4 to the point of beginning;

H. All the following lands within the Tecopa area described as follows:

Commencing at the quarter section corner common to Sections 10 and 11 T. 20 N., R 7 E., San Bernardino Meridian, the true point of beginning, and running thence S. 89 degrees 57 minutes W., 3962.77 feet to the northeast corner of the N. W. ¼ of the S. W. ¼, said township and range; thence south along the east side of said N. W. ¼ of the S. W. ¼ 659.19 feet to the southeast corner of the N. ½ of said N. W. ¼ of the S. W. ¼, thence west along the south boundary of the N. ½ of the N. W. ¼ of the S. W. ¼ 1322.27 feet to a point on the section line common to Sections 9 and 10, said township and range, said point being S. 0 degrees 04 minutes W., 657 feet from the quarter corner common to said Sections 9 and 10; thence from said point continuing west across Section 9 to a point on the north and south center section line 2650.17 feet, said point being the southwest corner of the N. W. ¼ of the N. W. ¼ of the S. E. ¼ of said Section 9, said point being S. 0 degrees 23 minutes W., 663.96 feet from the center of said Section 9; thence from said point N. 0 degrees 23 minutes E., 663.96 feet to the center of said Section 9; thence continuing N. 0 degrees 23 minutes E., 990 feet more or less to the northwest corner of S. ½ of the N. W. ¼ of the S. W. ¼ of the N. E. ¼ of said Section 9; thence east 2640 feet more or less to a point on the section line common to said Sections 9 and 10, said point being N. 0 degrees 04 minutes E. 985 feet from the quarter section corner common to said Sections 9 and 10, being the northeast corner of the S. ½ of the N. E. ¼ of the S. E. ¼ of the N. E. ¼ of said Section 9; thence east 5280 feet more or less to a point on the section line common to said Sections 10 and 11, said point being the northeast corner of the S. ½ of the N. E. ¼ of the S. E. ¼ of the N. E. ¼ of said Section 10; thence south along the section line 990 feet, more or less to the point of beginning;

I. All the following lands within the Shoshone area described as follows:

Beginning at the quarter section corner common to Sections 30 and 31, T. 22 N., R. 7 E., S. B. M.; thence northerly along the quarter section line 2640 feet more or less to the northeast corner of the southwest quarter of said Section 30; thence westerly 660 feet more or less along the north line of said southwest quarter of Section 30 to the southwest corner of the southeast quarter of the southeast quarter of the northwest quarter of said Section 30; thence northerly 1320 feet more or less to the northwest corner of the northeast quarter of the southeast quarter of the northwest quarter of said Section 30; thence westerly 660 feet more or less to northwest corner, southeast quarter of the northwest quarter of said Section 30; thence southerly 3960 feet more or less to the southwest corner of the southeast quarter of the southwest quarter of said Section 30; thence easterly 1320 feet more or less along the section line common to said Sections 30 and 31 to the points of beginning;

J. All the following lands within the Bishop area as follows:

  1. Parcel 1.

The easterly 660 feet of the north half of the northwest quarter of Section 8, T. 7 S., R. 32 E., M.D.B. & M., and the northerly 660 feet of the south half of the northeast quarter of said Section 8 and the northerly 660 feet of the easterly 660 feet of the south half of the northwest quarter of said Section 8,

  1. Parcel 2.

A strip of land 1320 feet in width lying 660 feet on each side of the centerline of the water right ditch, locally known as the Abelour ditch, extending in a northerly direction through portions of Section 16, 17, and 8, T. 7 S., R. 32 E., M.D.B. & M., the sidelines of said strip to terminate southerly on the centerline, or extensions thereof, of the water supply source for said Abelour ditch and northerly on the southerly line of the north half of the northeast quarter of said Section 8 said township and range;

K. All of the following described lands in the Alabama Hills:

Those portions of Sections 5, 6, 7, 8 and 9 Township 16 South, Range 36 East, M.D.M., in the County of Inyo, State of California lying within the following described lines:

Beginning at the intersection of the westerly line of Tuttle Creek Road 80 feet wide with the northerly line of Thundercloud Lane 40 feet wide; thence easterly along said northerly line to the one quarter corner common to said Sections 5 and 6; thence easterly to the center of said Section 5; thence southerly to the northwest corner of the southwest one quarter of the southeast one quarter of said Section 5; thence easterly, southerly and westerly along the boundaries of said southwest one quarter of the southeast one quarter, to the southwest corner thereof; thence southerly along the west boundary of the northeast one quarter of the aforementioned Section 8, to the southerly line of Indian Springs Drive 60 feet wide; thence westerly along said southerly line to the westerly line of the aforementioned Tuttle Creek Road; thence northerly thereon to the point of beginning.

Together with all that portion of the aforementioned Section 9 lying within the limits of Indian Springs Subdivision recorded in Book 2 Page 27 of Maps in the Office of the County Recorder of said County.

Also together with that portion of Indian Springs Drive, 60 feet wide bounded on the east by Indian Springs Subdivision, bounded on the west by the north, south one quarter section line of the aforementioned Section 8.

§ 8.04.030. Property owners rights and duties.

The owner of any land or premises described in Section 8.04.020 whereby the land or premises is located within the above boundaries specifically described in subsections A through J, or the person entitled to the possession of such land or premises upon which any stray animal is found shall have and enjoy all rights and duties specifically set forth and enumerated in Section 17041 of the Agricultural Code of the state.

§ 8.04.040. Violation-Misdemeanor.

The owner or person entitled to possession of any animal which becomes an estray and who wilfully and knowingly permits the animal to be an estray and to wander upon any of the land or premises described in subsections A through J of Section 8.04.020 without the consent or permission of the owner of the land or the person entitled to possession of the land is guilty of a misdemeanor.
