Chapter 8.08 — CREMATION OF DEAD ANIMALS

§ 8.08.010. Definitions.

In this chapter the singular includes the plural, the word "animal" includes every dumb creature, and the word "person" includes firms, corporations and associations as well as individuals. (Ord. 4 § 6, 1908)

§ 8.08.020. Cremation—Required.

Any person having the care, custody or control of any animal that dies shall cremate the same or cause the same to be cremated within twenty-four hours after receiving knowledge or information of the death of such animal.

§ 8.08.030. Cremation—Refusal—County action.

If the person having the care, custody or control of any animal that dies refuses or neglects to cremate the same or cause the same to be cremated within twenty-four hours after such person receives knowledge or information of the death of such animal, any peace officer of the county may and he is empowered and directed to immediately cremate such or cause the same to be cremated.

§ 8.08.040. Cremation—Stray animals.

Any peace officer of the county may and he is empowered and directed to cremate or cause to be cremated any estray animal or animals, the person having the care, custody or control of which is unknown, that dies within twenty-four hours after receiving knowledge or information of the death of such animal.

§ 8.08.050. County expenditure—Recovery.

Any moneys unnecessarily expended by the county or any peace officer thereof in the cremation of any animal that dies in the county shall be recoverable from the person having the care, custody or control of such animal, at the time of its death, by civil action in any court of competent jurisdiction.

§ 8.08.060. Cremation—Records.

Any peace officer of the county who cremates or causes to be cremated any animal that dies shall take and keep a record of the description of such animal, together with the marks and brands, if any, thereon.

Any person violating any of the provisions of this chapter is guilty of a misdemeanor.
