[Ord. No. 1834, 6-3-2026]
A. The approval or conditional approval of a vesting tentative map shall confer a vested right to proceed with development in substantial compliance with the ordinances, policies, and standards described in California Government Code Section 66474.2. Vested rights include density, design standards, improvement requirements, and development fees, unless tied to a later point in project approval.
However, if the California Government Code Section 66474.2 is repealed, the approval or conditional approval of a vesting tentative map shall confer a vested right to proceed with development in substantial compliance with the ordinances, policies, and standards in effect at the time the vesting tentative map is approved or conditionally approved.
The city may apply any ordinances, policies or standards that were formally published to amend applicable general or specific plans, subdivisions or zoning regulations prior to a vesting tentative map being received as a complete application and that are in effect on the date the city approved or disapproved the vesting tentative map.
B. Notwithstanding Subsection A of this section a permit approval, extension or entitlement maybe made conditional or denied if any of the following are determined:
A failure to do so would place the residents of the subdivision or the immediate community, or both, in a condition dangerous to their health or safety, or both.
The condition or denial is required, in order to comply with State or Federal law.
C. The rights referred to herein shall expire if a final map is not approved prior to the expiration of the vesting tentative map as provided in Section 5.06.07 (Expiration of Vested Maps). If the final map is approved, these rights shall last for the following periods of time:
An initial time period of one year beyond the recording of the final map. Where several final maps are recorded on various phases of a project covered by a single vesting tentative map, this initial time period shall begin for each phase when the final map for that phase is recorded.
The initial time period set forth in Subsection C(1) above, shall be automatically extended by any time used for processing a complete application for a grading permit or for design or architectural review, if such processing exceeds 30 days, from the date a complete application is filed.
A subdivider may apply to the City Council for a one-year extension at any time before the initial time period set forth in Subsection C(1) above, expires.
If the subdivider submits a complete application for a building permit during the periods of time specified in Subsection C(1) and (3) above, the rights referred to herein shall continue until the expiration of that permit, or any extension of that permit.
The developer who applies for an amendment pursuant to California Government Code Section 66498.2 shall do so prior to the expiration of vesting rights. The city shall process the application as a modification to tentative maps as contained in this Chapter. Approved modifications shall not extend the vesting period.

The City shall either deny the vesting tentative map or approve it subject to the condition that the subdivider, or the subdivider's designee, obtain the required amendment to the zoning regulations to resolve the inconsistency.
B. If the change in the zoning regulations is obtained, the approved or conditionally approved vesting tentative map shall, notwithstanding § 5.06.08A confer the vested right to proceed with the development in substantial compliance with the change in the zoning regulations and the map, as approved.
C. The rights conferred by this section shall be for the time periods set forth in § 5.06.08C.
