§ 9.70.010. Purpose.

The purpose of this Chapter is to prohibit garage sales, yard sales, and similar special sales events in residential districts.

§ 9.70.020. Definitions.

The following words, phrases, and terms as used in this Chapter shall have the meaning indicated below:

"Special sale event"

means and includes all general sales, open to the public, conducted from or on a residential premises in any residential zone without appointment, as defined by the Zoning Ordinance, for purposes of disposing of personal property, merchandise acquired for resale, or items obtained on consignment, and all sales entitled "garage," "yard," "attic," "porch," "room," "patio," "backyard," "flea market," or rummage" sale.

§ 9.70.030. Special sale events prohibition.

No person shall conduct a special sale event.

§ 9.70.040. Penalty for violation—Infraction.

Any person violating any of the provisions of this Chapter shall be guilty of an infraction offense and upon conviction thereof shall be punished by (1) a fine of not exceeding one hundred dollars ($100.00) for the first violation; (2) a fine not exceeding two hundred dollars ($200.00) for the second violation within one (1) year; and (3) a fine not exceeding five hundred dollars ($500.00) for each additional violation within (1) year. Each day a violation is committed or permitted to continue shall constitute a separate offense.
