§ 5.44.000. Purpose.¶
The purpose of this Chapter is to establish regulations for commercial mobile vehicle wash operations in the City to promote compliance with regulations on non-storm water discharge into the City's storm drain system; to provide controls for the discharge to City storm drains of runoff other than storm water; to reduce pollutants in storm water discharges to the maximum extent possible; and to support the intent of Chapter 16.52, Storm Water Management and Discharge Controls, of the Indian Wells Municipal Code and the Federal Clean Water Act.

§ 5.44.010. Definitions.¶
As used in this Chapter:
"Commercial mobile vehicle wash operation"
means any activity conducted for compensation that involves the washing or detailing of automobiles, trucks, motorcycles, recreational vehicles, or any other vehicle, and which is moved from one location to another, such as to serve customers at their residences or places of work.

§ 5.44.020. Regulations.¶
Commercial mobile vehicle wash operations shall comply with the following regulations:
(a) Operation shall be performed using a leak-proof groundcover containment device that will catch and contain all wastewater runoff from the vehicle wash operation for subsequent removal and recycling, or disposal to a legal point of disposal in a manner that complies with City, County, State and Federal regulations.
(b) The operation shall not be conducted on a public or private street.
(c) As a mobile business, it shall be conducted only at the place of residence or place of work of a customer and shall be by appointment only. No freestanding signage advertising the business is allowed, and non-appointment drive-up business is prohibited.
(d) Compliance with Chapter 16.52 of this Code is required.

§ 5.44.030. Business license required.¶
(a) All commercial mobile vehicle wash operations as defined by Section 5.44.010 above that are operating in the City shall obtain a City business license pursuant to Chapter 5.01 of this Code, and no person shall transact or carry on such business without having procured a license from the City to do so.
(b) Prior to the issuance of a business license for a commercial mobile vehicle wash operation, the license applicant or operator must show evidence that he or she possesses the appropriate vehicle wash runoff containment device and/or kit. A City Code Enforcement Officer or Inspector shall inspect the device and/or kit to ensure it will provide the necessary containment and approve such device before the license may be issued.
