4.40.010 - Establishment of a survey monument preservation fund.¶
Pursuant to Government Code Section 27584, the Imperial County board of supervisors establishes a survey monument preservation fund. This fund is established to pay the necessary expenses incurred or authorized by the county surveyor in any retracement or remonument survey of major historical land division lines upon which later surveys are based, such as, but not limited to, government section lines, rancho lines, grant lines, rancho section lines, acreage subdivision lot lines and subdivision boundary lines within Imperial County.

4.40.020 - User fee for survey monument preservation fund.¶
A. Pursuant to Government Code Section 27585, the Imperial County board of supervisors establishes a user fee for the limited purpose of financing the survey monument preservation fund. The user fee shall not exceed ten dollars ($10.00) per deed, or an amount set pursuant to Government Code Section 54985, and shall be charged and collected by the county clerk/recorder. The user fee shall be charged over and above any other fees required by law as a condition precedent to the recording of any grant deed conveying real property, exempting from such fees grant deeds conveying lots created by recorded tract maps.
B. The county clerk/recorder shall not record any grant deed subject to the user fee imposed by this section unless the user fee is paid at the time of recording.
C. Pursuant to Government Code Section 27585, the county clerk/recorder is directed to forward the user fees monthly to the county treasurer for deposit in the survey monument preservation fund. No funds collected by the county clerk/recorder for the survey monument preservation fund shall be transferred to, or deposited in, any other fund, or used for any other purpose.
