5.04.270 - Generally.¶
The rates of the license tax for the business, trades, occupations and employments hereinafter named in this article are, and the same are fixed in and for the City, in accordance with this article, and the same shall be paid by any person engaged in or about to engage in, or carrying on, or about to carry on the same in the City.

5.04.280 - Gross receipts license.¶
For any business or occupation not specifically set forth under a flat rate license section of this chapter, a quarterly license fee based upon average monthly gross receipts at the following rates:

All sales in excess of thirty-six thousand dollars ($36,000.00) per quarter will be two dollars ($2.00) for each one thousand dollars ($1,000.00) of the excess sales, plus the ninety-three dollars and sixty cents ($93.60) for the first thirty-six thousand dollars ($36,000.00).
Gross Receipts Defined. The term "gross receipts," as used in this section, is defined as follows:
The total amount of the sale price of all sales, the total amount charged or received for the performance of an act, service or employment of whatsoever nature it may be, whether such service act or employment is done as part of or in connection with the sale of goods, wares, merchandise or not, for which a charge is made, including all receipts, credit and property of any kind or nature, without any deduction therefrom on account of the costs of the property sold, the costs of the material used, labor or service costs, interest paid or payable, losses or any other expenses whatsoever; provided, that cash discount allowed or taken on sales shall not be included. Tax required by law to be included in or added to the purchase price and collected from the consumer or purchaser and such part of the sales price of any property previously sold returned by the purchaser to the seller which is refunded by the seller by way of cash or credit allowances given or taken as part payment on any property so accepted for resale, shall be deducted.

5.04.290 - Advertising and directories.¶
For the business of soliciting, advertising, compiling and/or publishing, distribution, etc., of City, business or other types of directories or listings, the sum of nineteen dollars and twenty cents ($19.20) per quarter or fraction thereof. Chapter 5.24 of this code shall apply when applicable.

5.04.300 - Apartment, cabin, dwelling units.¶
For the business of keeping or conducting apartment units, cabin units, dwelling units or similar type rental units; the following quarterly license shall apply in accordance with the number of units:

For the purpose of this chapter, "units" are defined as structures under one ownership, whether or not joined together or connected, intended or designated for or used as residences of families or households, living independently of one another.

5.04.310 - Catering trucks.¶
A. Every person having a fixed place of business within the City who operates a mobile food preparation unit or food unit selling packaged or prepared foods, hot or cold, shall pay an annual fee of four hundred dollars ($400.00).
Every person not having a fixed place of business within the City who operates a mobile food preparation unit or food unit selling packaged or prepared foods, hot or cold, shall be considered an itinerant vendor under the provisions of Section 5.04.650 of this chapter as amended.
B. In order to receive and maintain a City license, the applicant must possess a valid and current California health certificate issued by the Fresno County health department for the vehicle in use. The operators name and vehicle I.D. number is required to appear in the certificate. If, during the term of the City business license, the applicant shall fail to maintain a current and valid California health certification, the license shall be deemed to be immediately suspended, and if the applicant fails to obtain a valid certificate within thirty (30) days, the license shall be revoked.
C. The sale of prepared foods, by any vendor shall be prohibited in public rights-of-way and in any area within five hundred (500) feet for an established or existing commercial food service business.

5.04.320 - Auto races, motor events, horse races or similar type events.¶
Every person or firm conducting, carrying on or managing auto races, motor events, horse races or similar types spectator events shall pay a license fee in the sum of nineteen dollars and twenty cents ($19.20) per event.

5.04.330 - Automatic laundries (laundromats).¶
For the business of carrying on an automatic laundry (laundromat), one dollar and sixty cents ($1.60) per quarter for each washer and one dollar and sixty cents ($1.60) per quarter for each drier.

5.04.340 - Auctioneer.¶
Every auctioneer shall pay a license of forty-eight dollars ($48.00) per quarter; such license to be issued for a period of not less than one quarter.

5.04.350 - Barbershop.¶
For the business of conducting or carrying on a barbershop, forty dollars ($40.00) per quarter for three chairs or less whether operated or not operated, and four dollars and eighty cents ($4.80) per chair per quarter for each additional chair whether operated or not operated.

5.04.360 - Beauty parlor.¶
For the business of conducting or carrying on a beauty parlor, forty dollars ($40.00) per quarter for three or less operators, and four dollars and eighty cents ($4.80) per operator in excess of three.

5.04.370 - Billiard or pool hall.¶
For the business of conducting or carrying on a billiard, bagatelle or pool hall, sixteen dollars ($16.00) per quarter for each table used in the business.

5.04.380 - Billposting.¶
Every person engaged in the business of billposting shall pay a license fee of nine dollars and sixty cents ($9.60) per quarter.

5.04.390 - Blacksmith shop, welding shop, garage, general repair or maintenance service.¶
For the business of keeping or conducting a blacksmith shop, welding shop, garage, repair shop, maintenance service, janitorial service, or any service or repair of similar character and nature, the license fee shall be fourteen dollars and forty cents ($14.40) quarterly, plus an additional quarterly fee for parts, accessories and/or materials sold. The additional fee shall be measured as set forth in the table in Section 5.04.280 of this chapter.

5.04.400 - Boarders.¶
For the business of keeping boarders or furnishing meals to five or more persons for pay at places other than restaurants or lunch counters, forty dollars ($40.00) per quarter.

5.04.410 - Bowling or bocci alley or handball court.¶
For the business of keeping or maintaining a handball court, a bocci or bowling alley, the sum of sixty-four dollars ($64.00) per quarter.

5.04.420 - Box nailers and pre-coolers.¶
For the business of nailing boxes used in produce packing, eighty dollars ($80.00) per year, and for the business of pre-cooling and/or gassing refrigerated produce trucks or boxcars, eighty dollars ($80.00) per year.

5.04.430 - Boxing and wrestling matches or similar events.¶
Every person or firm conducting, carrying on or managing sparring, boxing or wrestling exhibitions, events or matches or similar events shall pay a license fee of eighty dollars ($80.00) per event.

5.04.440 - Brokers.¶
Every person engaged in the brokerage business, handling personal property, goods, wares or merchandise, whether on commission or otherwise, shall pay a license of fourteen dollars and forty cents ($14.40) per quarter.

5.04.450 - Campground or trailer court.¶
For the purpose of keeping or conducting a campground (other than a labor camp) or trailer court for the accommodation of motorists or other persons, fifty-six dollars ($56.00) per quarter.

5.04.460 - Cannery, packing house and manufacturing plant.¶
For the business of keeping or conducting a cannery, packing house, processing plant, cotton gin, manufacturing plant or any industrial plant of similar nature, the sum of six hundred forty dollars ($640.00) per year, except for agricultural cooperatives which shall be one hundred sixty dollars ($160.00) per year.
For the business of keeping or conducting a lettuce cooling operation, the sum of eight hundred dollars ($800.00) per tube per year.

5.04.470 - Carnival.¶
For the business of conducting or exhibiting any aggregation of shows where one fee or separate fees are charged for admission to such show, the sum of nine hundred sixty dollars ($960.00) per week. This provision shall not be considered to apply to any circus, performance, exhibition or sideshow provided for in later sections of this code, but is intended and does apply to what are commonly known as "carnival shows" and other similar aggregations of shows. No such aggregation of shows shall do business in any part of the City without permission first obtained from the city council.
The amount chargeable under this section shall not be proratable.

5.04.480 - Street musicians.¶
For the business or occupation of a roving street musician (including mariachi bands), for each such individual or band, the sum of one hundred twenty dollars ($120.00) per musician, per quarter.

5.04.490 - Christmas trees, greens and holly berries.¶
For the business of carrying on or managing the business of selling Christmas trees, greens, holly berries, decorations, Christmas cards or other similar items relating to the Christmas season, except where such business is conducted in conjunction with a regularly established place of business for which a license has been issued, the sum of nineteen dollars and twenty cents ($19.20) per quarter or portion thereof.

5.04.500 - Circus.¶
For the business of conducting or exhibiting any circus, caravan, menageries or collection of animals or other acrobatic performances, the sum of one hundred ninety-two dollars ($192.00) per day.

5.04.510 - Coin-operated sound-motion picture machines.¶
For the business of maintaining and operating sound-motion pictures or television machines, instruments or screens, which machines, instruments or screens are played or operated through the insertion of coins into such machines or slot connected therewith a viewing fee is charged, nineteen dollars and twenty cents ($19.20) per quarter for each of such machines, instruments or screens.

5.04.520 - Concrete pipe.¶
Every person engaged in the business of manufacturing concrete pipe or other concrete products or vitrified clay products shall pay a license of thirty-eight dollars and forty cents ($38.40) per quarter.

5.04.530 - Contractors.¶
A. Every person or firm who engages in the business of a contractor in the building trades shall pay a license of forty dollars ($40.00) per quarter. Any contractor who sells merchandise in connection with a contracting business shall pay an additional license for doing business as a merchant under Section 5.04.280 of this chapter in addition to the forty dollars ($40.00) quarterly license. Every person or firm engaged in the business of a contractor must produce evidence that he holds a valid State Contractor's License before a license will be issued under this section. Contractors applying for a first license shall pay forty dollars ($40.00).
B. "Contractors" shall include:
Boilers, hot water heating, steam-fitting;
Building, general;
Cabinet and millwork;
Cement and concrete;
Classified specialists;
Electric signs;
Electrical, general;
Elevator installation;
Excavating, grading, trenching, paving surfacing;
Flooring, wood;
Flooring, sanding and finishing;
Glazing;
House and building moving, wrecking;
Insulation;
Landscaping;
Lathing;
Masonry;
Ornamental metals;
Painting, decorating, paper hanging;
Plastering;
Plumbing;
Refrigeration;
Roofing;
Seer, sewage disposal, draining, cement pipe laying;
Sheet metal;
Steel, reinforcing;
Steel, structural;
Structural pest control;
Tile, ceramic and mosaic;
Warm-air heating, ventilating, air-conditioning;
Welding;
Well drilling.

5.04.540 - Creamery.¶
Every person who conducts a creamery, cream receiving station, skimming station, whole milk plant or dry milk factory or cheese factory in the City shall pay a license of seventy-six dollars and eighty cents ($76.80) per quarter.

5.04.550 - Dances.¶
Every person, firm or group carrying on, managing or conducting a public dance or similar event in the City shall pay a license fee of eighty dollars ($80.00) per quarter or event.

5.04.560 - Topless dancers or waitresses.¶
Every person, firm or group carrying on, employing, managing or conducting, topless dancers or topless waitresses, the sum of one thousand six hundred dollars ($1,600.00) per quarter.

5.04.570 - Fixed base and crop dusting operations.¶
Every person, firm or group carrying on a fixed base crop dusting operation, the sum of three hundred twenty dollars ($320.00) per quarter.
Every person, firm or group carrying on a crop dusting operation (transient), the sum of thirty-two dollars ($32.00) per plane per day.

5.04.580 - Dry cleaning and laundry (outside firms only).¶
Every person or firm engaged in the business of soliciting and accepting orders, delivery and pickup of dry cleaning, dyeing, washing of clothes, rugs, linen or similar items for work or service to be done outside the City shall pay a license of twenty-four dollars ($24.00) per quarter.

5.04.590 - Feat or performance.¶
For the business of exhibiting or charging a fee for the use of any microscope, lung or muscle tester, phonographic diversions, ball, knife or ring throwing, galvanic batter or any other feat or performance or diversion of a similar character not in this chapter specified or named, the sum of nineteen dollars and twenty cents ($19.20) per day.

5.04.600 - Finance or lending agencies.¶
Every person or firm engaged in the business of operating a finance or lending firm or agency, not excluded by Section 5.04.200 of this chapter, shall pay a license fee in the sum of forty-eight dollars ($48.00) per quarter.

5.04.610 - Fortuneteller.¶
Every astrologer, seer, fortuneteller, hypnotist, clairvoyant, spiritualist, spiritualist medium or phrenologist who demands or accepts a fee or gratuity of his or her services, engaged in or about to engage in business in the City, shall pay a license of the greater of either one hundred twenty dollars ($120.00) per quarter or the amount which would be payable pursuant to Section 5.04.280 of this chapter if this section were not applicable.

5.04.620 - Hauling.¶
For the business of operating or running any truck, dray, job wagon or other vehicle, horse or motor-driven, used for commercial operation or for hire, excepting common carriers, other than for rock, gravel, sand, ready-mix, concrete or any other commodity of similar nature within the City, the sum of fourteen dollars and forty cents ($14.40) per quarter for each such vehicle. If the above-mentioned vehicles are used in connection with a regularly established business covering the above-mentioned materials, the license shall be seventy-six dollars and eighty cents ($76.80) per quarter for such business.

5.04.630 - Hotels.¶
For the business of keeping or conducting a hotel of twenty (20) rooms or under, forty dollars ($40.00) per quarter; twenty-one (21) rooms to thirty (30) rooms, inclusive, fifty-two dollars ($52.00) per quarter; thirty-one (31) rooms to sixty (60) rooms, inclusive, seventy-two dollars ($72.00) per quarter; sixty-one (61) rooms to eighty (80) rooms, inclusive, eighty-eight dollars ($88.00) per quarter; and ten dollars ($10.00) per quarter for an additional ten rooms over eighty (80) rooms, but in no event shall such license tax exceed the sum of ninety-six dollars ($96.00) per quarter.

5.04.640 - Ice cream on streets.¶
Every person engaged in the business of selling ice cream, snow cones, soda water, fruit juices, lemonade or any other soft or temperate drinks, or any confection, upon the streets of the City shall pay a license of forty dollars ($40.00) per quarter; provided, permission shall first be obtained from the city council.

5.04.650 - Itinerant vendor.¶
Every person engaged in the business or occupation of itinerant vendor shall pay a license of two hundred forty dollars ($240.00) per day.
The words "itinerant vendor" shall be construed to mean and include all persons, both principal and agent, who engage in a temporary and transient business in the City of Huron, selling articles or services of any class or character, with the intention of continuing the business in the City of less than ninety (90) days, and who for the purpose of carrying on business have no fixed place of business, or hire, lease or occupy any room, building or structure therein for the exhibition or sale of such articles, or from which room, building or structure the sales are to be made, or solicit business by means of samples or delivery from house to house. Any person or firm so engaged shall not be relieved from the provisions of this section by reason of associating temporarily with any local dealer, trader, merchant or auctioneer or by conducting the temporary or transient business in connection with, or as part of, or in the name of any local dealer, trader, merchant or auctioneer.
All itinerant vendors shall obtain licenses and permits as are set forth in Chapter 5.24 of this code and for this purpose the chief of police is authorized to charge a fee of forty dollars ($40.00) to cover the cost and expense of obtaining a background check and such other items as the chief of police shall in his absolute discretion deem necessary in order to clear said itinerant vendor.

5.04.660 - Regulation of vending vehicles.¶
Street vendor vehicles shall not stop, stand, park, sell merchandise or sound bells or other sound devices on streets, alleys or public ways adjacent to school buildings or school grounds between the hours of eight a.m. and four p.m. on any school day; or on any streets, alleys or public ways adjacent to any church on Sunday prior to twelve noon, or at any time on streets adjacent to hospitals or hospital grounds.

5.04.670 - Junk dealer and secondhand store.¶
For the business of junk dealer, fifty-seven dollars and sixty cents ($57.60) per quarter; for the business of conducting a secondhand store, thirty-eight dollars and forty cents ($38.40) per quarter.

5.04.680 - Labor camps.¶
For the business of keeping, maintaining or operating a labor camp, one hundred sixty dollars ($160.00) per quarter.

5.04.690 - Mechanical games.¶
For the business of maintaining and operating mechanical games, mechanical rides, mechanical devices or mechanical instruments of any kind, twenty-four dollars ($24.00) per quarter for each of such games or devices. Nothing herein shall be construed as permitting the licensing of any mechanical games or device whereby prizes of merchandise or money or anything of value are awarded, paid or given by reason of or connected with the operation or playing of such a game or device.

5.04.700 - Amusement rides.¶
For the business of operating or conducting a merry-go-round, ferris wheel, sky flier, whip, loop-o-plane, aeroplane, or similar types of amusement rides, the sum of nineteen dollars and twenty cents ($19.20) per day, or fraction thereof, for each of such rides, provided that such business shall be carried on in the City at such places and under such rules and regulations as may be directed by the chief of police. No license shall be issued under this section if such amusement rides are in conjunction with or conducted as a part of what is commonly known as a "carnival" as set forth in Section 5.04.470 of this chapter.

5.04.710 - Minstrels.¶
For each exhibition of minstrels, operatic or concert singers, the license shall be the same as required for theatrical performances.

5.04.720 - Motels.¶
For the business of keeping or conducting a motel of twenty (20) rooms or under, twenty-eight dollars and eighty cents ($28.80) per quarter; twenty-one (21) rooms to thirty (30) rooms, inclusive, thirty-eight dollars and forty cents ($38.40) per quarter; thirty-one (31) rooms to sixty (60) rooms, inclusive, forty-eight dollars ($48.00) per quarter; sixty-one (61) rooms to eighty (80) rooms, inclusive, sixty-seven dollars and twenty cents ($67.20) per quarter, eighty-one (81) rooms to ninety (90) rooms, inclusive, eighty-six dollars and forty cents ($86.40) per quarter; and nine dollars and sixty cents ($9.60) per quarter for an additional ten rooms over ninety (90), but in no event shall such license tax exceed the sum of ninety-six dollars ($96.00) per quarter.

5.04.730 - Newspaper.¶
Every person engaged in the business of printing or publishing a newspaper in the City shall pay a license of fifty-seven dollars and sixty cents ($57.60) per quarter, if a daily newspaper, or nineteen dollars and twenty cents ($19.20) per quarter, if other than a daily newspaper.

5.04.740 - Nurseries.¶
Every person who engaged in the business of selling or soliciting orders for nursery stock, trees, shrubs, vines or plants shall pay a license of nineteen dollars and twenty cents ($19.20).

5.04.750 - Parking lots.¶
For the business of keeping or conducting a public parking lot where rental is charged, shall pay a license of nineteen dollars and twenty cents ($19.20) per quarter, for a lot containing twenty-four (24) spaces or less. For a lot containing twenty-four (24) spaces or more, nineteen dollars and twenty cents ($19.20) per quarter plus eighty cents ($0.80) per each space over twenty-four (24) per quarter.

5.04.760 - Pawnshops.¶
Every person engaged in the business of conducting or carrying on a pawnshop or acting as a pawnbroker shall pay a license fee of ninety-six dollars ($96.00) per quarter.

5.04.770 - Phonographs.¶
For the business of maintaining and operating phonographs or mechanical musical instruments through the insertion of coins into such machines or slots connected therewith, sixteen dollars ($16.00) per quarter for each of such phonographs or machines.

5.04.780 - Photographic studio.¶
For every photographic studio or gallery, permanently located, nineteen dollars and twenty cents ($19.20) per quarter, where no merchandise is sold other than photographs and frames; where other photographic merchandise is sold, see Section 5. 04.280 of this chapter.

5.04.790 - Professions.¶
Each person who at a fixed place of business in the City conducts the business or profession as hereinafter designated in one office, or suite of offices, whether a partner, employee or associate shall pay a license per quarter as hereinafter designated.

5.04.800 - Public scales.¶
For the business of operating a public scale or scales, thirty-two dollars ($32.00) per quarter for each scale. The fee shall be additional to any fee for any other business operated in conjunction therewith.

5.04.810 - Radio broadcasting.¶
Every person engaged in the business of radio broadcasting in the City shall pay a license of fifty-seven dollars and sixty cents ($57.60) per quarter.

5.04.820 - Real estate.¶
For the business of buying or selling real estate on commission, for one person engaged in buying or selling in the business, the sum of fourteen dollars and forty cents ($14.40) per quarter, and for each additional person the sum of nine dollars and sixty cents ($9.60) each per quarter.

5.04.830 - Shoe shining.¶
Every person engaged in the business of keeping or conducting a boot-blacking or shoe-shining parlor or stand not carried on in connection with a barbershop shall pay a license of four dollars and eighty cents ($4.80) per quarter.

5.04.840 - Shooting gallery, skating rink, traveling rink or shooting gallery.¶
For the business of conducting a shooting gallery or skating rink, the sum of thirty-eight dollars and forty cents ($38.40) per quarter.

5.04.850 - Shuffle boards.¶
For the business of maintaining and operating shuffle boards, eight dollars ($8.00) per quarter.

5.04.860 - Sideshow.¶
For each show for pay or any panorama, figures jugglers, necromancers, magicians, wire or rope dancing, sleight of hand performance or any other sideshow, the sum of nineteen dollars and twenty cents ($19.20) per day, and whenever a separate admission price is charged, each must be considered a separate show.

5.04.870 - Signs.¶
Every person soliciting orders for or selling signs shall pay a license of nineteen dollars and twenty cents ($19.20) per quarter.

5.04.880 - Supplying or distributing bakery goods or milk.¶
For the business of supplying bakery goods or milk or distributing the same to the inhabitants of the City by vehicle, forty dollars ($40.00) per quarter, per vehicle.

5.04.890 - Tailor shops.¶
For the business of conducting a tailor shop, nineteen dollars and twenty cents ($19.20) per quarter.

5.04.900 - Theatres and shows.¶
For the business of conducting or carrying on theatres, tent or other shows, if in a fixed place of business for less than one quarter, nine dollars and sixty cents ($9.60) per pay day; for one quarter every theatre, tent or other show having a seating capacity of seven hundred (700) persons or more, one hundred fifteen dollars and twenty cents ($115.20) per quarter; under seven hundred (700) persons, fifty-seven dollars and sixty cents ($57.60) per quarter; all others shall pay a license of forty-eight dollars ($48.00) per day or one hundred ninety-two dollars ($192.00) per week.

5.04.910 - Tombstones.¶
Every person conducting or maintaining a marble or tombstone shop or soliciting orders for marble or tombstone work shall pay a license of twenty-eight dollars and eighty cents ($28.80) per quarter.

5.04.920 - Trained animals.¶
For the business of conducting or exhibiting any show where the exhibition consists solely of trained animals, the sum of nineteen dollars and twenty cents ($19.20) per day; provided, this provision shall not be considered to apply to any circus, or any performance, exhibition or sideshow provided for in Sections 5.04.500 and 5.04.860 of this chapter.

5.04.930 - Undertaker.¶
For the business of carrying on an undertaking establishment in the City, the sum of forty-eight dollars ($48.00) per quarter.

5.04.940 - Vending machines.¶
For the business of maintaining and operating mechanical vending machines whereby merchandise is sold to the public from such machines by the insertion of coins therein, a license per quarter as follows:
Not over one cent ($0.01), up to ten machines, five dollars and seventy-five cents ($5.75); each additional machine, forty cents ($0.40);
Not over one cent ($0.01), up to ten machines, nineteen dollars and twenty cents ($19.20); each additional machine, one dollar and ninety-two cents ($1.92);
Over ten cents ($0.10), up to ten machines, twenty-eight dollars and eighty cents ($28.80); each additional machine, two dollars and eighty-five cents ($2.85).

5.04.950 - Warehouse.¶
Every person engaged in the business of conducting or operating any warehouse, tank, building, or device for the storage of grain, hay or other farm products, merchandise or goods of other persons, for profit, shall pay a license of forty dollars ($40.00) per quarter for each warehouse, tank, building or other device.

5.04.960 - Washing cars.¶
For the business of washing cars, either by hand, semi-automatically, not part of a business license under another section of this chapter, twenty-four dollars ($24.00) per quarter.

5.04.970 - Wholesale delivery by vehicle.¶
Every person not having a fixed place of business within the City who delivers wholesale groceries, wares, machinery or merchandise of any kind by vehicle, motor-driven or otherwise, to retail stores in the City shall pay a license of twenty-eight dollars and eighty cents ($28.80).
