3-12-1: - GASOLINE LEAF BLOWERS WITHIN THE CITY.

A. No person shall use or operate any portable machine powered with a combustion or gasoline engine used to blow leaves, dirt and other debris off sidewalks, driveways, lawns and other surfaces within any area of the City.

B. No owner of real property, tenant in possession of real property, or person in control of real property shall allow the use or operation any portable machine powered with a combustion or gasoline engine used to blow leaves, dirt and other debris off sidewalks, driveways, lawns and other surfaces on the real property.

3-12-2: - SPECIFIC PROHIBITION OF LEAF BLOWERS ON PARKWAYS, STREETS AND TRAILS.

A. The use or operation of leaf blowers on parkways, roadways, streets and pedestrian or equestrian trails is prohibited.

B. No person shall cause another person to use or operate a leaf blower on parkways, roadways, streets and pedestrian or equestrian trails.

C. As used in this Section, a leaf blower is defined as any portable machine powered with a combustion or gasoline engine or is electric or battery-powered and is used to blow leaves, dirt and other debris for removal.

3-12-3: - ENFORCEMENT; PENALTIES AND VIOLATION.

A. The Planning Director or his/her designee and/or the Sheriff, as appropriate, shall have the authority to enforce the provisions of this Chapter. Such officials may issue citations, notices to appear and any other notices initiating procedures pursuant to the provisions of Chapters 5 of Title 1, including Section 1-5-8, of this Code related to administrative citations.

B. A violation of this Chapter shall constitute an infraction.

C. Alternatively, any person violating the provisions of this Chapter may be issued an administrative citation pursuant to the provisions of Chapter 5 of Title 1 of this Code.

D. Nothing in this chapter shall limit or preclude the enforcement of any other applicable laws or remedies available for violations of this Chapter, including, but not limited to, the enforcement provisions of Chapter 5 of Title 1 of this Code.
