3-13-1: - SHORT TITLE AND AUTHORITY.

A.

This Chapter may be cited as the "Construction and Demolition Site Control Measures Ordinance of the City of Hidden Hills."

B.

The City Manager or designee, in consultation with the City Attorney's Office, is authorized to create or amend administrative guidelines (the "Administrative Guidelines") for the implementation and interpretation of this Chapter.

C.

Application. Except for demolition permit projects, projects that have been permitted and have commenced work prior to July 9, 2025 (effective date of this Chapter) are not subject to the requirements of Section 3- 13-4(B)(4) of this Chapter. However, all projects that do not have approved Dust Control plans because they began construction before this Chapter was in effect must take reasonable steps to prevent dust from leaving the site. If there are three significant fugitive dust events at a property without a Dust Control Plan, as determined by the Building Official or designee, during the duration of the project, a stop work notice may be issued and the Builder may be required to prepare a Dust Control Plan, submitted for review and approval by the City, to be maintained and implemented on the site at all times in compliance with Section 3-13-4(B)(4). Pools that have been permitted prior to July 9, 2025, are not subject to the requirements of Section 3-13-4(A)(6).

3-13-2: - PURPOSE.

In order to prevent excessive construction dust harmful to respiratory health, and other construction related nuisances, it is necessary to implement reasonable standards on construction-related activities.

3-13-3: - DEFINITIONS.

The following words, phrases and terms as used in this Chapter shall have the meanings indicated as follows:

Builder means the party engaging in or directing construction and construction-related activities pursuant to this Chapter.

Construction means any demolition, site preparation, grading, assembly, erection, substantial repair, alteration or similar action for or of public or private right-of-way, structures, utilities or similar property.

Dust Control Plan means a plan to reduce dust produced by construction-related activities as required by this Chapter.

Third party air quality monitoring program means monitoring and reporting ambient air quality to the City during construction as required by this Chapter.

3-13-4: - CONSTRUCTION STANDARDS, DUST CONTROL PLANS AND MONITORING.

A.

Residential and Non-Residential Construction.

Waste containers, including roll-offs and trash bins, shall be located on the construction site and reasonably screened from public view, and the locations shall be notated on the site plans and approved by the City. Waste containers shall not be placed on the roads or parkways, except as permitted by the Hidden Hills Community Association. Waste containers shall be covered where possible and shall not be overfilled.

The site shall be kept clean and free of any trash or other debris not related to construction.

Roadways, parkways, and trails shall be cleaned by the builder daily to remove any nails, screws, trash, soil, mud, and debris originating from the site.

The following statement shall be included in all plans and is a requirement of all construction: "The site shall be kept clean of trash and debris not related to construction. Roads, parkways, and trails shall be kept free of dirt, mud, nails, screws, trash, or other construction debris originating from the site. Builder shall inspect and clean the site and roadway, parkway, and trails at the close of each day on which there was construction activity."

The following construction work is prohibited during red flag warning days: grading, demolition, use of any outdoor equipment, or outdoor activity that could cause a spark or flame.

Pool draft hydrants, for Fire Department use at the street, are required for all new pools.

Portable toilets shall be located on the construction site and reasonably screened from public view. Locations are to be shown on the site plans and approved by the city. Portable toilets shall be emptied or replaced at a minimum of twice per week.

Power construction equipment (including combustion engines), fixed or mobile, shall be equipped with noise shielding and muffling devices consistent with manufacturers' standards or the Best Available Control Technology. All equipment shall be properly maintained, and the applicant or owner shall require any construction contractor to keep documentation on-site during any earthwork or construction activities demonstrating that the equipment has been maintained in accordance with the manufacturer's specifications.

Construction noise audible from an adjacent residence or activity that shakes or vibrates residences off-site shall not begin before 8:00 a.m., unless approved by the Building Official.

Vehicles driving or parking on decomposed granite parkways or on the construction site shall provide dust control mitigation measures. Regular watering, or other dust mitigation measures approved by the Building Official, shall be utilized.

The builder must respond within one hour to complaints received via the numbers listed on the sign required by Section 3-13-4(B)(1)(c).

B.

Residential and Commercial Construction Projects Involving Grading, New Homes, Large Remodels (50 percent or more) and Demolition Projects.

At least 1 week before commencement of excavation and/or construction activities, a laminated weather- resistant wood sign shall be posted on the site by the builder, stating the following:

a.

Notice of pending construction and the job site address.

b.

Anticipated commencement and timeframe of construction.

c.

Contact information with two names and phone numbers of the owner or owner's representatives that can be called 24 hours a day, 7 days a week for emergencies. One of the numbers must be for the person who will be supervising the construction activity while it occurs. The same names and phone numbers shall be noted on building permits.

d.

e.

Current and verified phone number for the South Coast Air Quality Management District complaint line, including the proper extension to the complaint department.

The sign shall be posted on the front of 3 rail fences, flush with and extending below the top of the fences. Such signs shall be visible and readable from the public road right-of-way. See City Building and Safety standard detail for size, color, font, etc.

At least 14 days prior to construction, all City of Hidden Hills properties within 500 feet of the project site and no less than two properties away in every direction, or further if deemed necessary by the Building Official due to the unique characteristics of a property, shall be notified of the commencement of construction. Builder shall provide radius maps, mailing labels, and stamped envelopes of properties that shall be noticed to the City as part of the application for City verification.

Builder shall hang door tags at all residences notified above, at the commencement of any work that has the potential to cause off-site dust, vibrations, toxic odors, or excessive and prolonged noise. Door tags shall include the information specified in Section 3-13-4(B)(1)(a)—(e) of this Chapter. Additional door tags shall be required if there are scheduling changes or if such work is discontinued and recommended later.

Neighbors objecting to the placement of door tags may opt out of this notification by emailing the city at staff@hiddenhillscity.org.

A Dust Control Plan shall be included on plans, submitted for review and approval by the City, and always maintained and implemented on the site. The Dust Control Plan shall be submitted to the City for City approval. The Dust Control Plan is also required for interior remodels, which may require using HEPA filters for ventilation to the area of work. Plans shall comply with South Coast Air Quality Management District (SCAQMD) and State of California standards and shall include:

a.

Location and proper maintenance of dust fences.

b.

Schedule for watering down site (permanent source of water to be on site).

c.

Plans for use of vegetation and/or chemical stabilizer (non-toxic, environmentally safe stabilizers).

d.

Where chemical stabilizers are not used, multiple daily applications of water are required on days when there is construction, and immediately prior to weekends and holidays, to minimize visible dust.

e.

Regular wheel washing.

f.

Maximum speed limit of 15 mph for all vehicles on the construction site.

g.

All equipment and vehicles carrying construction debris or material capable of creating dust must be covered by a tarp during transport and safety secured.

h.

Builders shall begin pre-watering the site at least 72 hours before grubbing or grading.

i.

Builders shall call for City inspection the day prior to grubbing the site or commencing grading or construction to verify the pre-watering.

j.

Builders shall take all necessary measures to minimize dust travelling off the project site, even beyond those listed in the dust control plan.

k.

The dust control plan shall be maintained and implemented for at least one week after construction is completed.

Observance of fugitive dust, or failure to comply with the Dust Control Plan, may result in a stop-work notice and fines until remedial measures, satisfactory to the City, are implemented. If, during construction, there are three significant fugitive dust events, as determined by the Building Official or designee, during the duration of the project, additional dust control protocols shall be added to the Dust Control Plan and implemented to prevent dust from leaving the site.

Prior to the issuance of a permit for demolition, the applicant must submit proof of review and approval from SCAQMD that the proposed demolition is compliant with SCAQMD asbestos standards of Rule 1403. If a hazardous material survey and abatement is required, a certificate from a California-licensed hazardous materials contractor shall be submitted to the City certifying that all hazardous materials have been properly abated.

The building shall be cleared of all pests and vermin (rats, possums, raccoons, etc.), without the use of poisons or rodenticides, by a licensed pest control company. Prior to the issuance of a building permit, a certificate from the licensed company must be provided to the City stating the pest control company's name, the name of the licensed exterminator, and a statement certifying that the building has been cleared of all pests and vermin.

3-13-5: - VIOLATIONS.

A.

No building permit, certificate of occupancy or other entitlement for use may be issued, pursuant to the ordinances of the City, unless an appropriate officer of the City determines that the project for which the permit is sought fully complies with the requirements of this Chapter.

B.

If during the project it comes to the attention of the Building Official of the City that construction is deviating from the plans approved by the City in a manner that will result in a failure to comply with the requirements of this Chapter, the Building Official shall authorize the issuance of one or more stop work orders pursuant to the ordinances of the City.

C.

The provisions of this Chapter may be enforced by any other means permitted by the ordinances of the City or by other law.
