5.52.020 - Blinder newsracks.

No person shall display or exhibit in any public place or place open to the public, other than a location from which minors are excluded, any harmful matter, unless a devise commonly known as a "blinder rack" is in place so that the lower two-thirds thereof is not exposed to public view. For the purposes of this section, "harmful matter" is as defined in California Penal Code Section 313 as currently in effect and as may be amended.

5.52.030 - Penalty for violation.

It is unlawful for any person to violate any provisions, or to fail to comply with any of the requirements, of this chapter. Any person violating any provision of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof may be punished by a fine not exceeding one thousand dollars ($1,000.00), or by imprisonment in the county jail for not more than six months, or by both such fine and imprisonment. A person shall be deemed guilty of a separate offense for each and every day or any portion thereof during which any violation of any of the provisions of this chapter is committed, continued, or permitted by such person.
