SEC. 1-1.00 - TITLE.

This Code shall be known as the "HAYWARD MUNICIPAL CODE".

SEC. 1-1.01 - CITING IN PROSECUTIONS.

In any prosecution fur the violating of any provision of this Code, it shall be sufficient to refer to the Code as the "Hayward Municipal Code".

SEC. 1-1.02 - AMENDATORY ORDINANCES.

Any ordinance adding to, amending or repealing this Code may be designated as an addition or amendment to, or repeal of, the "Hayward Municipal Code".

SEC. 1-1.03 - FORMER ORDINANCES.

The provisions of this Code, insofar as they are substantially the same as ordinances heretofore adopted by the City of Hayward, shall be construed as restatements and continuations thereof and not as new enactments.

SEC. 1-1.04 - PRIOR ORDINANCE VIOLATIONS.

Prosecution for violation of ordinances committed prior to the effective date of this Code shall not be affected by the adoption of the Code or by its repeal of such ordinances.

SEC. 1-1.05 - LICENSES AND PENALTIES.

Neither the adoption of this Code nor its repeal of any ordinance shall be construed as a waiver of any license or penalty due and unpaid under such ordinance at the effective date of this Code, or be construed as affecting any provision of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to the violation thereof.

SEC. 1-1.06 - BONDS AND DEPOSITS.

Neither the adoption of this Code nor its repeal of any ordinance shall affect the validity of any bond or cash deposit required to be posted, filed or deposited pursuant to such ordinance; and all rights and obligations thereunder shall continue in full force and effect.

SEC. 1-1.07 - MATTERS OF RECORD.

This Code shall not affect deposits or other matters of record which refer to, or are otherwise connected with, ordinances which are therein specifically designated by number or otherwise and which are included in the Code; but such reference shall be construed to apply to the corresponding provisions of this Code.

SEC. 1-1.08 - SAVING CLAUSE.

If any Chapter, Article, Section, subsection, sentence, clause or phrase of this Code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Code, and the Council of the City of Hayward hereby declares that it would have adopted this Code and each Chapter, Article, Section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one (1) or more of other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

SEC. 1-1.09 - ORDINANCES REPEALED.

All ordinances or parts of ordinances in conflict with the provisions of this Code are hereby repealed.

SEC. 1-1.10 - CONSTRUCTION OF CODE.

The provisions of this Code and all proceedings under it are to be liberally construed, with a view to effect its objects and to promote justice.

SEC. 1-1.11 - HEADINGS.

Chapter, Article and Section headings contained herein shall not govern, limit, modify or affect the scope, meaning or intent of the provisions of this Code.

SEC. 1-1.12 - NOTICE. HOW GIVEN.

Any written notice required by the provisions of this Code, unless it is herein otherwise specifically provided, may be given either by personal service or by mail. In case of service by mail, the notice must be deposited in the United States Post Office, postage prepaid and addressed to the person on whom it is to be served at his last known address, as the same appears in the records pertaining to the matter to which such notice is directed. Such service shall be deemed completed at the time of deposit in the post office.

SEC. 1-1.20 - LIMITATIONS OF ACTIONS.
