§ 8.32.010. Code adopted.

Pursuant to the provisions of the Government Code of the state and subject to the exceptions and provisions hereinafter enumerated, the city council hereby adopts as the fire prevention code of and for the city that certain code marked and designated the Uniform Fire Code of 1994 as amended by the Los Angeles County Board of Supervisors, known as the 1996 Los Angeles County Fire Code (Los Angeles County Code) of which code not less than one copy has been and is now filed in the office of the city clerk, and same is adopted and incorporated as though fully set forth herein and from the date on which this section shall take effect the provisions thereof shall be controlling within the limits of the city.

§ 8.32.020. Bureau of fire prevention established.

The Fire Prevention Code shall be enforced by the city's fire department, which is established and shall be operated under the supervision of the chief of fire services. The chief of fire services may detail such members of the fire department to said bureau to act in the capacity of inspectors as shall from time to time be necessary.

§ 8.32.030. Storage of explosives and blasting agents.

The limits referred to in Article 77 of the Los Angeles County Fire Code as adopted pursuant to Section 8.32.010 hereof, in which storage of explosives and blasting agents is prohibited, are hereby established in all land use zones except zones M-1 and M-2.

§ 8.32.040. Modifications.

The chief of fire services has the power to modify any of the provisions of the Uniform Fire Code, as adopted pursuant to Section 8.32.010 hereof, upon application in writing by the owner or lessee or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modifications when granted or allowed and the decision of the chief of fire services thereon shall be entered upon the records of the fire department and a signed copy shall be furnished to the applicant.

§ 8.32.050. New materials, processes or occupancies which may require permits.

The city manager, the chief of fire services, and the chief of the bureau of fire prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits, in addition to those now enumerated in said Code. The chief of fire services shall post such a listing in a conspicuous place thereof to interested persons.

§ 8.32.060. Amendments to the Los Angeles County Fire Code.

The Los Angeles County Fire Code is amended by substituting, adding and/or deleting thereto the following designated sections:

A. Article 24 Section 2402.3.2 is hereby amended to read as follows:

2402.3.2 Aircraft refueler units shall be electrically bonded to the aircraft being fueled or defueled. Transfer nozzles shall be equipped with approved bonding conductors which shall be clipped or otherwise positively engaged with the bonding attachment provided on the aircraft adjacent to the fuel tank cap. Bonding connections, required by Section 2402.3.2 shall be made prior to fuel transfer and shall not be disconnected until fuel transfer operations are completed. See Uniform Fire Code Standard 24-1 and NFPA 407—1990 for additional information on bonding and grounding.

B. Article 29 Section 2903.4.2. is hereby amended to read as follows:

2903.4.2 Lubricating Oil. Lubricating oil which has been drained from motor vehicles in Group S, Division 3 or Group H, Division 4 occupancies shall be stored and handled as required for Class IIIA liquids in accordance with Article 79.

C. Article 52 Section 5201.6.1 is hereby amended to read as follows:

5201.6.1 General. The dispensing of fuel into the fuel tanks of automobile, aircraft, or portable containers shall be under the supervision of a qualified attendant at all times.

Exception: Unsupervised dispensing of flammable and combustible liquids, LP-gas and CNG as a motor fuel is allowed at the airport and at private fleet operations in accordance with Sections 5201.6.3, 5202, 5203 and 5204 of the 1994 Uniform Fire Code.

D. Article 78 Section 7802.3 is hereby amended to read as follows:

7802.3 Safe and Sane fireworks, as defined in Division 1, Chapter 6 of Title 19, of California Code of Regulations, are permitted for use and sale in the City of Hawthorne in accordance with Municipal Code Chapter 8.34.

E. Article 82 Section 8204.1 is hereby amended to read as follows:

8204.1 General. The storage and transportation of LP-gas and the installation and maintenance of pertinent equipment shall be in accordance with Uniform Fire Code Standard 82-1 and subject to the approval of the Chief, except as provided in Article 82. Liquefied petroleum gas containers with a water capacity of over 50 gallons are prohibited in land use zones H, P-R, R-1, R-2, R-3 and R-4. Maximum aggregate capacity at one location shall not exceed 150 gallons.

§ 8.32.070. Limitation and restrictions pertaining to recreational fires within the…

Cooking, recreational or ceremonial outdoor fires on private property are restricted and limited as follows: Such outdoor fires are solely allowed in commercially produced containers or containers specifically approved by the Los Angeles County fire department. Such outdoor fires may be fueled only by coal, charcoal briquettes, white gas, natural gas or liquefied natural gas.
