16.18.010 - Purpose and intent.

The City Council finds that improperly operated or maintained decorative water ponds and swimming pools provide a breeding place for mosquitoes, which are dangerous and injurious to the health, welfare, and safety of residents in the vicinity of these ponds and pools and throughout the City and region and as such constitute a public health nuisance.

16.18.020 - Responsibilities of owners and operators.

All owners of property that contain decorative water ponds and/or swimming pools and all operators of such decorative water ponds and/or swimming pools shall at all times properly maintain and operate these decorative water ponds and/or swimming pools in a manner that does not allow the decorative water pond and/or swimming pool to become a breeding place for mosquitoes, including emptying and keeping dry any decorative water ponds and/or swimming pools that are abandoned and/or not in service.

16.18.030 - Violations and penalties.

Violation of any part of this section shall be a misdemeanor pursuant to the Hawaiian Gardens Municipal Code.

16.18.040 - Nuisance abatement and assessment procedures.

Nuisance abatement and assessment procedures against owners and/or operators of decorative water ponds and/or swimming pools shall be in conformance with Sections 16.14.020 through 16.14.150 of the Hawaiian Gardens Municipal Code.
