§ 5.24.010. Distribution to pedestrians and vehicles.

It is unlawful for any person to distribute or cause to be distributed, circulate or pass, or cause to be circulated or passed, to or among pedestrians along or upon any public street, park, alley or other public place in the city or to place in any vehicle or other public place in the city, any advertising samples, handbills, dodgers, circulars, booklets or other notices of commercial advertising.

§ 5.24.020. Distribution to public places and private premises.

It is unlawful for any person to distribute or throw, or cause to be thrown, upon any street, park, alley or any other public place or in or upon any private yard, lawn, driveway, sidewalk, porch or steps of any residence or upon or in any part of any structure or building or upon any vacant property or in any mailbox in the city any advertising samples, handbills, dodgers, circulars, booklets or other notices of commercial advertising.

§ 5.24.030. Exceptions to provisions.

The provisions of this chapter shall not prohibit:

A. The distribution and delivery of any newspaper entered as second class matter under the provisions of the United States Postal Regulations and other United States statutes or the delivery of any such advertising matter by the United States postal service. All newspapers distributed shall consist of the entire issue of the newspaper so distributed and the distribution of a special page or special portion of a newspaper containing commercial advertising shall constitute a violation of the provisions of this chapter;

B. The distribution and delivery of any newspaper that shall have at least 25% of its printed contents made up on local or telegraphic news and the balance thereof consisting of advertisements and other printed matter and which newspaper shall have a bona fide subscription list within the city;

C. The distribution, peddling and delivery of any newspaper of general circulation, as defined by the laws of the state or any legally issued magazine into dwelling houses or business places of residents within the city who are subscribing to such newspaper or magazine; and

D. The distribution, peddling or delivery of any handbill, poster, dodger, pamphlet or paper containing printed, painted or typewritten advertising or other notices or advertising matter which has been designed, painted, printed or otherwise composed by or for the benefit of any religious, charitable or benevolent society or corporation or by any political subdivision of the state or any state, county or city institution.
