§ 16.28.010. Waivers authorized.

The council adopts the provisions of this chapter in order to adopt rules, regulations and specifications for division of land waivers, either by lease, sale or financing of any land into four parcels or less hereafter made within the city and as may be annexed to the city.

In addition to those divisions of land exempted from the requirements of the Subdivision Map Act by Section 66412 of said Act, a division of land may also be exempted from the requirements of Chapter 16.16 of this title and a waiver authorized when the proposed division of land is determined to be one of the following:

A. A lot line adjustment between two or more adjacent parcels where the land taken from one parcel is added to an adjacent parcel, and where a greater number of parcels than originally existed is not thereby created, provided the minimum zoning requirements pertaining to lot area, width, depth and building setbacks are met;

B. A parcel created by a recorded contract of sale previous to the adoption by the state of the Parcel Map Requirements on March 4, 1972;

C. The financing, leasing or sale of property for commercial and industrial uses located within a lawfully approved shopping center site or industrial park site where the proposed parcel complies with the minimum requirements of the zone district in which it is located;

D. The financing or leasing of parcels for the construction of a removable building having a floor area of less than 100 square feet (photo-mats and the like); or

E. For the merger of four or fewer contiguous parcels, under the same ownership, where one or more lot lines are eliminated to merge the property into one parcel and where the proposed parcel complies with the minimum requirements of the zone district in which it is located.

§ 16.28.020. Applications.

An application for a parcel map waiver shall be made to the planning director on a form prescribed by the planning director, which form shall include the following data:

A. A map eight and one-half inches by 14 inches;

B. The name and address of the owner of record;

C. The name and address of the applicant;

D. The boundary line of the entire parcel, including the area to be divided, with dimensions based on existing survey data, or the property description;

E. The proposed division lines;

F. The dimensions of the proposed parcels;

G. The approximate acreage or square footage of the parcels;

H. Each parcel identified with a letter;

I. All existing surface and underground improvements shall be indicated and dimensioned for all parcels;

J. The number of stories or height of each existing structure;

K. The names, widths and locations of the existing and proposed streets;

L. The private streets;

M. The location, purpose and owners of existing or proposed easements or private rights-of-way (shown by dotted lines);

N. The legal descriptions of the original parcel and the proposed parcels;

O. The date;

P. The north arrow;

Q. The scale (one inch equals 200 feet, minimum; one inch equals 50 feet for small parcels);

R. The existing and proposed uses of the property;

S. The method of sewage disposal;

T. The source of water;

U. The assessor's parcel numbers;

V. The new street names;

W. The location and width of watercourses and areas subject to flooding;

X. The locations of structures, irrigation ditches and other permanent fixtures;

Y. The locations of railroads, if any; and

Z. A curve radii and key map.

§ 16.28.030. Designation of advisory agency and required findings.

A committee composed of the planning director and the public works director, or their designated representatives, is designated as the advisory agency for the approval of the waiver of parcel map requirements, and prior to such approval such advisory agency shall make the findings required by Section 66428 of the Government Code of the state.

§ 16.28.040. Improvements.

In approving the waiver of a parcel map for a division of land, the advisory agency shall require the subdivider to install, construct, and/or provide all on-site and off-site improvements and the dedication of rights-of-way or easements pursuant to the provisions of Chapter 16.24.

§ 16.28.050. Certification of waivers.

When a division of land has been determined to qualify for a parcel map waiver, a certificate of waiver shall be issued to the applicant who shall record such certificate concurrently with the deed, contract of sale, or lease. A copy of both recorded documents shall be filed with the planning department before the certificate shall become final.
