Sec. 7-5-31. - Generally.

There is hereby created a volunteer fire department which shall be known as the city volunteer fire department. The city manager or designee shall be responsible for the overall administrative control of the city volunteer fire department. The city fire chief shall be appointed by the city manager and shall serve under the supervision of the city manager. The city fire chief shall be responsible for management, administration, and provisioning of the city volunteer fire department.

Sec. 7-5-32. - Membership.

(a) The city volunteer fire department shall consist of the following:

(1) Fire chief;

(2) Assistant fire chief;

(3) Second assistant fire chief;

(4) As many assistant fire personnel, who shall volunteer as such, as the council may from time to time provide for, appoint, and/or designate; and

(5) Such other honorary members as the city volunteer fire department may recommend.

(b) Such appointments shall be made upon the recommendation of the fire chief according to the constitution and bylaws of the city volunteer fire department.

Sec. 7-5-33. - Constitution and bylaws.

The city volunteer fire department shall be governed by a constitution and bylaws provided by the fire department, subject to the approval of the city council and under the supervision of the city manager or designee.

Sec. 7-5-34. - Duties of fire chief.

The fire chief shall have the following duties:

(1) To attend all fires unless for good and sufficient reason unable to do so.

(2) To investigate the cause of every fire occurring in the city and make a written report of such investigation.

(3) To aid in the enforcement of all fire regulations enacted by federal, state, county or local regulation.

(4) To examine buildings in the process of erection, to report violations of regulations relating to the prevention and extinguishments of fires.

(5) To institute proceedings as per law for any violations found in the examination of such buildings.

(6) To have the care, control, and custody of all the apparatus, appliances, and materials belonging to or being used by the fire department and the premises where equipment may be kept.

The city fire chief or designee shall file a written report of all incidents within the city which involve responses by city volunteer fire department personnel. The fire chief shall have the authority to designate such personnel as may be qualified to assist him in the performance of the duties of this section.

Sec. 7-5-35. - Badges.

The fire chief shall be entitled to have and to display an appropriate badge of his office. Each assistant firefighter shall be entitled to have and display an appropriate badge of office. The fire chief shall furnish such badges to each active firefighter.

Sec. 7-5-36. - Duties of members.

Members of the city volunteer fire department shall attend all fires in the city and perform such duties in suppressing any fire as may be directed by a fire services supervisor. Additionally, members of the city volunteer fire department shall assist with fire suppression and rescue duties in locations outside the city when directed to do so by a fire services supervisor. It shall be the duty of all assistant fire personnel to obey the orders and instructions of the fire chief in all matters concerning the fire department.

Sec. 7-5-37. - Duty to safeguard property.

Members of the city volunteer fire department have a duty and responsibility to safeguard all public and private property under their control or supervision.
