Sec. 5-7-1. - Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Yard sale means any event where items of personal property, other than a licensed commercial business, are to be offered for sale to the general public. The term "yard sale" shall include garage, patio, and similarly conducted sales.

Sec. 5-7-2. - Violations.

Any person violating any provision of this chapter shall be guilty of an infraction.

Sec. 5-7-3. - Permit.

(a) Every person conducting a yard sale shall obtain a permit. The permit shall include an affidavit stating that all property to be sold is personal property and has not been acquired or consigned to him for the purpose of resale. The permit fee shall be set by resolution.

(b) No such permit shall be issued without the approval of the council. Whenever any person desires such a permit, such person shall petition the council for a permit therefor, which petition shall state the name of the applicant, the character and location of the proposed business, and any other information, which the council may by resolution, require. On consideration of such petition, the council may authorize the permit to be issued in whole or in part or rejected in whole or in part.

Sec. 5-7-4. - Frequency.

Each premises shall be limited to three yard sales per 12-month period, each to be limited to not more than three consecutive days.

Sec. 5-7-5. - Signs.

Signs advertising yard sales shall be displayed only on the days of the sale. No sign shall be posted on any utility pole, street sign, or street tree. All such signs shall be removed within two days after the yard sale is completed.

Sec. 5-7-6. - Inspections and enforcement.

All personal property to be sold at a yard sale shall be arranged so that fire, police, health, and other officials may have access at all times during the sale. The enforcement of the provisions of this chapter shall be by the police department and all officers of the city charged with the enforcement of laws.
