Chapter 15.44 — RURAL STREET OVERLAY ZONE

§ 15.44.010 INTENT AND PURPOSE. ¶
(A) This zone is intended to minimize conflicts in rural neighborhoods between the existing residential development pattern and new residential development or substantial additions to existing residences.
(B) This zone is an overlay zone, to be used only with an underlying residential base zone.
(C) The requirements imposed by this zone are intended to supplement those requirements contained in the base zone.

§ 15.44.020 OVERLAY ZONE. ¶
The application of this zone shall be signified by the designation of a “RS” suffix following the base zone designation on the official zoning map along with a unique designation for the neighborhood to which it applies. Since different neighborhoods qualify to become a “Rural Overlay” but may have different design goals, separate “Rural Overlay” designations shall be applied to each neighborhood when the overlay is implemented and unique designations given to each neighborhood. For example, the use of this zone in conjunction with the R-l10,000 Zone in the Pico-Carhart neighborhood would be designated as “R-l-10-RS-PC.”

§ 15.44.030 DEFINITIONS. ¶
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. NEW RESIDENTIAL DEVELOPMENT. Includes construction of all new single-family residences or subdivision of land for future development of new single-family residences.
RURAL STREET. Includes all streets shown on General Specific Plan No. 86.

§ 15.44.040 PROCEDURE FOR REVIEW OF REQUESTS FOR A RURAL STREET ZONE DESIGNATION. ¶
(A) Planning Commission or City Council may approve a notice of intention to initiate establishing the overlay designation in a neighborhood.
(B) If at least 51% of the property owners of the defined neighborhood sign a petition, the Development Services Department shall initiate a zone amendment to consider the request to reclassify the defined neighborhood to the particular Residential Rural Street Zone. (C) The consideration of the zone amendment to apply a Rural Street Zone to a defined neighborhood shall be subject to Chapter 15.72 of this title.

§ 15.44.050 CRITERIA FOR DESIGNATION. ¶
Only those properties that front onto a designated rural street as established by General Specific Plan 86 qualify to be designated a “Rural Street Overlay.”

§ 15.44.060 RURAL STREET DESIGN GOALS. ¶
(A) All proposed development, including subdivisions, substantial additions to existing single-family residences, and construction of new homes shall adhere to the adopted neighborhood design goals.
(B) All subdivisions, new homes, substantial additions or remodels and minor additions and remodels will be reviewed for consistency with the neighborhood design goals using the following process:
(1) New subdivisions are reviewed by the Planning Commission for compliance with the adopted neighborhood design goals, the Subdivision Map Act, Cal. Gov’t Code Title 7, Division 2 (commencing with § 66410), and Titles 15 and 16 of this code.
(2) New homes or additions to homes that meet the criteria identified in § 15.47.020 are subject to a site plan application per Chapter 15.47 of this title and are reviewed for compliance with the adopted neighborhood goals. A determination by the Director of Community and Economic Development that an application does not meet the design goals may be appealed to the Planning Commission.
(3) The Director of Community and Economic Development and the Planning Commission may impose conditions and standards, in addition to the standards in the underlying zone, as will ensure the design goals specified above are met.

§ 15.44.070 ADOPTION OF RURAL STREET DESIGN GUIDELINES. ¶
(A) At the time a rural street overlay is established for a neighborhood, design guidelines shall be prepared for review by the Planning Commission and adoption by the City Council.
(B) The design guidelines may be amended periodically. Unless an amendment to the design guidelines would significantly restrict the development rights of an impacted property owner, no public notice is required to revise the guidelines.
