SEC. 5-401. - RULES AND REGULATIONS.¶
(a) The Director of Aviation ("Director") may make such rules and regulations as are not inconsistent with the provisions of this article, and as may be necessary or desirable to aid in the administration or enforcement of this article and Airport operations.
(b) All persons on Airport property shall be governed by applicable laws, this article, and rules and regulations of the Director.

SEC. 5-402. - AIRPORT¶
"Airport" as used in this article shall mean: (1) Fresno Yosemite International Airport which is identified as "FAT" by the Federal Aviation Administration and/or (2) Fresno Chandler Executive Airport which is identified as "FCH" by the Federal Aviation Administration.

SEC. 5-403. - FEES, FARES, RATES AND CHARGES.¶
The Council shall designate in the Master Fee Resolution, the fees, fares, rates, and charges for services provided by Airport.

SEC. 5-404. - RESTRICTIONS AND CONDUCT AT AIRPORT.¶
(a) These rules and regulations are not intended to amend, modify or supersede any provisions of federal, state or local law.
(b) Any permission granted by the city or Director, either directly or indirectly, expressly or by implication, to any person to enter upon or use the Airport shall constitute an agreement by the person to comply with any and all city, state or federal rules, regulations or laws, including but not limited to compliance with Federal Aviation Administration and Transportation Security Administration rules, regulations and plans.
(c) No person shall engage in any business or commercial activity on the Airport except with the approval of, and under such terms and conditions as may be prescribed by the Director.
(d) No person shall post, distribute or display signs, advertisements, circulars or printed material without first obtaining the approval of the Director.
(e) No person shall take still, motion or sound pictures at the Airport for commercial purposes without first obtaining a license or permit from the Director, except duly authorized newspaper or television news media personnel may take pictures of newsworthy events for newspaper or television display only.
(f) The Director may promulgate reasonable rules and regulations to regulate the time, place and manner of charitable solicitations and the distribution of religious, political or commercial literature, including newspapers, parading, demonstrating and assembling. Such rules and regulations shall be precisely drawn to protect constitutional rights and promote legitimate governmental interests, including but not limited to preventing unreasonable interference with pedestrian and vehicular traffic, preventing fraud, preventing undue harassment of passersby, and preventing undue interference with the business operations of the airport. Such rules and regulations may include the establishment of a permit system.
(g) Any person damaging Airport property shall report such damage to the Director and may be responsible to the city for any expense required to repair such damage.
(h) No person shall bring any animal upon the Airport unless such animal is on a leash or caged. No person shall bring any animal into any Airport public building except service animals or an animal properly confined for shipment by air.
(i) No person shall travel on any portion of the Airport except on roads, walks or places provided for the particular class of traffic nor occupy the roads or walks in such a manner as to hinder or obstruct their proper use.
(j) No person shall enter any restricted area posted as limited to "Authorized Persons Only," or similar wording without proper identification and authorization.
(k) No person shall enter any air operations area of the Airport without authorization of the Director.
(l) No person shall drink any intoxicating liquors nor have in his possession any open containers of intoxicating liquors upon any portion of the Airport open to the public except in such restaurant or other place as shall be properly designated and licensed for on-sale liquor dispensing.
(m) Except as authorized by law, no person shall carry any firearms, destructive device or explosive on the Airport.
(n) No person shall dispose of garbage, paper, waste, refuse or other material in the Airport public areas except in receptacles provided for that purpose.

SEC. 5-405. - LOST OR UNCLAIMED PROPERTY.¶
Lost or unclaimed property on Airport shall be received, kept, sold, and disposed of as required in Chapter 4, Article 3 of this Code unless governed by superseding federal laws or regulations.

SEC. 5-406. - AIRCRAFT OPERATIONS¶
(a) No person shall navigate any aircraft upon, fly aircraft from, or conduct any aircraft operations on or from the Airport otherwise than in conformance with the current Federal Aviation Administration and United State Department of Transportation Rules, and other federal laws, State law, this Code, and the rules and regulations of the Airport.
(b) The pilot or person in charge of any aircraft involved in an accident shall immediately remove such aircraft and any wreckage or debris caused by such accident to a place designated by the Director unless such person is required by federal law or regulation to leave the same in place for investigation.
(c) The Director may order the removal and/or impoundment of aircraft at the owner's expense upon a delinquency of and pending payment of fees under the Master Fee Resolution. If the aircraft is impounded, no owner, operator, lienholder, receiver or other trustee of such aircraft shall thereafter remove such aircraft without first paying all delinquent fees, the expenses of aircraft removal and impoundment incurred hereby, and any other applicable charges.

SEC. 5-407. - TRAFFIC REGULATIONS WITHIN AIRPORT.¶
(a) Pursuant to the authority of Section 21113(c) of the Vehicle Code all provisions of the Vehicle Code relating to traffic upon the highways shall be applicable at the Airport. The Council designates the following as subject to the Vehicle Code:
(1) Roadways as entrances to or exits from Airport;
(2) Points where vehicles must come to a stop before proceeding;
(3) Places for crosswalks;
(4) Roadways as service roadways, roadways open to the public or private roadways;
(5) Places where roadways shall be divided into lanes;
(6) The direction and manner in which vehicles shall proceed.
(b) The Director is authorized to erect signs, make markings and erect or place official traffic control devices and official traffic signals giving notice thereof, which signs, markings, devices and signals shall conform to the provisions of Section 21401 of the Vehicle Code.

SEC. 5-408. - PARKING REGULATIONS.¶
(a) The Director is authorized to designate:
(1) Places where vehicles may or may not be parked;
(2) The period of time for which vehicles may be parked at any place; and shall make appropriate markings giving notice thereof which markings shall conform to the provisions of Section 21401 of the Vehicle Code.
(b) Except as otherwise provided herein, persons shall park vehicles only in those areas designated by signs as public parking areas. It is further provided that:
(1) No person shall park any vehicle in any public parking area except between the painted lines indicating where vehicles shall be parked;
(2) No person shall so park any vehicle in any public parking areas so as to use or occupy more than one marked parking space.
(c) No person shall park or stop any vehicle at the Airport:
(1) In any restricted parking, stopping or standing zone for a time longer than provided for by the display of appropriate signs or curb marking, or in violation of any other limitation or restriction set forth in any sign or curb marking.
(2) In any zone where the display of appropriate signs and/or curb markings indicate that parking, stopping or standing at such location is not permitted.
(d) All drivers of vehicles entering upon any public parking area shall follow and comply with any directional markers or signs therein.
(e) No person shall park any vehicle for hire in any place other than a place provided therefor and appropriately marked as such.
(f) No person shall park any vehicle other than a vehicle for hire in any place set aside for the parking of vehicles for hire.
(g) The Director is authorized to remove any vehicle parked on any roadway, parking area or other posted property on Airport in violation of this Code, and to impound the same at owner's expense.

SEC. 5-409. - ENFORCEMENT AUTHORITY.¶
Enforcement of these rules and regulations at airport shall be the responsibility of those persons employed by city as airport peace officers and airport parking enforcement officers. Airport peace officers may enforce any provision of this article. Airport parking enforcement officers may enforce any provision of Sections 5-407 and 5-408 of this Code. Airport parking enforcement officers are public officers within the meaning of California Penal Code Section 836.5 and not peace officers. In addition, traffic regulations may be enforced by any duly authorized peace officer, including, but not limited to, the Fresno Police Department and the California Highway Patrol which are by this reference specifically authorized to enter upon the roadways within Airport for the purpose of enforcement of Vehicle Code provisions.
