6.40.010 - Purpose and authority.

The purpose of this chapter is to establish a system for registering weighing and measuring instruments and to recover the costs of inspecting and testing such instruments, pursuant to Section 12210 of the California Business and Professions Code. The authority for this Chapter is Article 2.1 (commencing with Section 12240) of Chapter 2 of Division 5 of the Business and Professions Code.

6.40.020 - Definitions.

As used in this chapter, unless the context otherwise requires:

A. "Weighing and measuring instruments" means "weighing instruments" and "measuring instruments," as defined by Section 12500 of the Business and Professions Code.

B. "Commercial purposes" shall have the meaning assigned to it by Section 12500 of the Business and Professions Code.

C. "Weights and measures division" means the weights and measures division of the Fresno County department of agriculture.

D. "Person" shall have the meaning assigned to it by Section 1.04.020 of this code and Section 12011 of the Business and Professions Code.

E. "Sealer" means the sealer of weights and measures and his duly authorized agents.

F. "Location" shall have the meaning assigned to it by Section 12240(o) of the Business and Professions Code.

6.40.050 - Fees.

The annual fee for instruments to be used at locations shall be as set forth in the County of Fresno Master Schedule of Fees, Charges and Recovered Costs for Fresno County.

6.40.100 - Violation.

Violation of any of the provisions, or the failure to comply with any of the mandatory requirements of this chapter shall constitute an infraction.
