4.56.010 - Use of county funds and recovery of costs for graffiti removal.

Pursuant to Section 53069.3 of the Government Code, county funds may be used to remove graffiti or other inscribed material from privately or publicly owned real or personal property within the county and to replace or repair privately or publicly owned property within the county that has been deface with graffiti or other inscribed material that cannot be removed cost effectively. Removal, repair or replacement of privately owned property may be performed only after securing the consent of the owner or possessor. Removal, repair or replacement of publicly owned property may be performed only after securing the consent of the public entity having jurisdiction over the property. County funds may not be used to remove, repair or replace parts of property not defaced.

The county may seek to recover its costs of repair, removal or replacement of defaced privately or publicly owned property in a civil action against the person or persons responsible for the graffiti or other inscribed material, and against the parent or guardian of an offending minor pursuant to Civil Code Section 1714.1

In addition to using county funds and recovering the costs for graffiti removal as described above, the county encourage the courts to assign offenders to community work programs for graffiti removal as authorized by state law. The county may also use community volunteers in county-sponsored graffiti removal activities.
