4.44.010 - Title.

This chapter shall be known as the master schedule of fees, charges and recovered costs for county services ordinance of the county of Fresno. It is adopted in order to facilitate compliance with the requirements of Chapter 12.5 (commencing with Section 54985) of Part 1 of Division 2 of Title 5 of the Government Code.

4.44.020 - Master schedule.

The fees, charges and recovered costs to be charged and collected for the rendering of specified services by the various county departments shall be as set forth on a master schedule. Except as set forth herein, the master schedule and any changes thereto shall be adopted by ordinance in the manner prescribed by law and changes thereto shall constitute an amendment of this chapter. Public facilities fees, as authorized by Chapter 17.88 of this code, fees and charges authorized by Chapter 466 of the Statutes of 1990, fees setting forth the hourly rate to be charged for services provided by employees in the Weights and Measures/Standards/Statistics Division of the Agriculture Department, and fees and charges required by law to be established by resolution shall be adopted by resolution or ordinance in the manner prescribed by law. Such master schedule and any changes thereto, adopted as provided herein by such amendments, shall not be included in this code. The schedule shall contain an internal section numbering system and each change in the schedule shall be identified by reference to the numbered section and subsection affected. The master schedule and each amendment thereto shall be filed with the clerk to the board of supervisors and be made available for public inspection and review.

4.44.030 - Cancellation of returned check fee.

A. For purposes of this section:

  1. "Check" means negotiable paper given as payment for property taxes.

  2. "Returned check fee" means a fee established by the board under Section 2509.1 of the Revenue and Taxation Code, and set forth on the master schedule provided in section 4.44.020, to be charged by the auditor-controller/treasurer-tax collector to any taxpayer whose check is returned unpaid, for costs arising from nonpayment of the check.

  3. "Taxpayer" means a person who attempts payment of property taxes by check.

B. A returned check fee may be canceled by the auditor-controller/treasurer-tax collector upon written request by the taxpayer and a finding that a check was returned unpaid due to reasonable cause and circumstances beyond the taxpayer's control, notwithstanding the exercise of ordinary care in the absence of willful neglect, provided the payment of property taxes is made no later than ten days after the taxpayer is notified in writing that he or she has been charged the returned check fee.
