9-6.01 - Purpose.¶
The purpose of this chapter is to mitigate the impact of future residential development within the City upon the school facilities of the Fowler Unified School District.

9-6.02 - Applicability.¶
This chapter shall apply to any new residential development or the enlarging of an existing residential development either by way of, though not limited to, rezoning, subdivision approvals, conditional use permits, or building permits.

9-6.03 - Notices required.¶
Upon an application by any person, firm, or corporation to increase the existing residential stock within the City, the applicant shall be provided with a written notice to comply with this chapter by contacting and providing the school district with all the information required to evaluate the potential impacts of such development.

9-6.04 - Verification of agreement required.¶
Prior to issuing any final approval or permit authorizing the construction of new or enlarged residential capacity within the City, the applicant shall secure a written verification from the Fowler Unified School District that it has agreed upon or met mitigation measures found applicable to such development.

9-6.05 - Reservation of authority.¶
The Council expressly reserves the authority to review and approve any agreement between the school district and an applicant on its own motion or at the request of an affected person. The City staff is directed to advise the Council of any deviation from the pre-existing policies of the Council with regard to such developments, fees, or procedures and to withhold issuing any approval or permit which does not meet such existing policies. All other approvals or permits which meet such policies may be issued without prior Council approval as otherwise provided.
