8-3.01 - Adoption of the California Residential Code.

The City adopts by specific reference thereto and incorporation herein by said reference, in their entirety, the California Residential Code, current edition, including appendix chapters, amendments, supplements, and errata as promulgated by the California Building Standards Commission. One paper copy of each shall be maintained on file and available for public inspection during normal business hours at Fowler City Hall.

8-3.02 - Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter and in said Housing Code are defined as follows:

(a) "Building Chief" shall mean the County Health Officer and his deputies.

(b) "Building Official" shall mean the City Superintendent and any assistant or any employee of his office designated by him as a building official.

(c) "City" shall mean the City of Fowler.

(d) "City Attorney" shall mean the City Attorney of the City of Fowler.

(e) "Construction" shall mean and include construction, erection, enlargement, alteration, conversion, or movement.

(f) "Municipality" shall mean the City of Fowler.

8-3.03 - Administration.

The provisions of this chapter and said Housing Code shall be administered by the office of the City Superintendent and the personnel provided therefor from time to time by the City Superintendent and the City.

8-3.04 - Violations—Penalties.

Any person who shall violate or fail to comply with any provision of said Housing Code or this chapter, or who shall construct any building or structure, or cause the same to be done, contrary to or in violation of any of the provisions of this chapter or said Housing Code shall be punishable as set forth in Chapter 2 of Title 1 of this Code.

Each such person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation of any provision of this chapter or said Housing Code is committed, continued, or permitted.

The provisions of this chapter and said Housing Code may also be enforced by an injunction issued by the Superior Court upon a suit of the City or of the owner or person in possession of any real property affected by such violation or prospective violation. Such method of enforcement shall be cumulative and shall in no way affect the penal provisions of this section.
