Sec. 9.04.010. - Firearms.

(a) Defined. As used in this section, the term "firearm," means a device commonly known as a pistol, revolver, gun, rifle, or shotgun, which is expelled through a barrel, a projectile by the force of an explosion or other form of combustion.

(b) Discharge prohibited; penalties. Any person who discharges a firearm within the town limits is guilty of a misdemeanor and upon conviction thereof, punishable by a fine of not more than $1,000.00 or by such imprisonment for not more than six months, or by both such fine and imprisonment.

(c) Exception for authorized officials. This section shall not apply to duly appointed peace officers who are carrying out official duties while in the town, or any person summoned by such peace officer to assist in making arrests or preserving the peace while he/she is actually engaged in assisting such officer.

(d) Exemption by permit. The town police chief may, in the chief's discretion considering all relevant circumstances, issue a permit allowing the discharge of firearms for a period not to exceed one day, providing that the person making application for permit gives satisfactory evidence that the discharge is not for unlawful purpose, that reasonable precautions have been taken to prevent injury to persons or property from the discharge, and that the discharge will not unreasonably disturb the occupants of adjoining properties.

Sec. 9.04.020. - Loitering.

Loitering in the town is prohibited. Loitering occurs when a person:

(1) Wanders upon the streets from place to place without apparent reason or business and refuses to identify himself and to account for his presence when requested by any peace officer so to do, if the surrounding circumstances are such as to indicate to a reasonable person that the public safety demands such identification;

(2) Prowls or wanders upon the private property of another, in the nighttime, without visible or lawful business with the owner or occupant thereof;

(3) Remains in or about any toilet open to the public for the purpose of engaging in or soliciting any lewd or lascivious acts or committing any of the following offenses:
