16.01.010 - Established duties.

A department to be known as the water department of the city is established. Such department shall have charge and control of the water system of the city, and of all things necessary or incidental to such system. Such department shall be, at all times, subject to the control of the city council, or such person or persons as the city council shall from time to time designate.

16.01.020 - Definitions.

Unless the context specifically indicates otherwise, the following terms and phrases, as used in this title and in the rules and regulations promulgated pursuant to it, shall have the meanings hereinafter designated:

"Agricultural user" means a person or entity who using more than one hundred HCF (ten thousand cubic feet) of water each month cultivating soil or growing and harvesting crops on at least two full acres of land.

"City manager" means the city's city manager and his or her designee.

"CPI" means the Consumer Price Index of the Bureau of Labor Statistics of the U.S. Department of Labor for Urban Wage Earners and Clerical Workers, Los Angeles - Long Beach, California and index based period (1982-84 = 100) for the most recent available twelve months.

"Dwelling unit" means one or more rooms in a building or portion thereof, designed, intended to be used for occupancy by one family for living and sleeping quarters, and containing only one kitchen, not including hotels or motels (section 6.04.9610, Fillmore Municipal Code.) For purposes of this title dwelling unit also includes mobile homes, travel trailers and manufactured housing when used as permanent living quarters.

"Equivalent residential unit," or "ERU," means the volume of water used by an average residential dwelling unit within the city on an average day. For purposes of this title the term may be used interchangeably with dwelling unit and is the basic unit for establishing connection and service charges.

"FAHR" or "fully allocated hourly rate" means the hourly pay rate of the class of employee involved, marked up to include all direct and indirect costs of employment, including, but not limited to: Overtime pay and insurances.

"Finance department" means the city's finance department.

"Finance director" means the city's finance director or his or her designee.

"Mobile home" means a transportable, factory-built home designed to be used as a year-round residential dwelling.

"Manufactured housing" means factory-built, single-family detached housing that is constructed to the National Construction and Safety Standards Act of 1974.

"Travel trailer" means a vehicle designed to be drawn by a motor vehicle, of such size and weight as not to require special highway movement permits when used on the public highways, for human habitation, usually for recreational or emergency occupancy.

"User" means the owner of a property that is properly and lawfully connected to the city potable water system and may include the singular or plural based on the context of the use.

"Water DIF" means the amount of the city's then current Water Development Impact Fee.
