Article 2 — STATUTORY AUTHORITY / ENFORCEMENT AUTHORITY

  • §2.01 The statutory authority for Zoning is Article 11, Section 7 of the California Constitution. §2.02 All departments, officers and public employees vested with the duty or authority to issue permits, certificates or licenses shall issue no permit, certificate or license for use, buildings or purposes within the City in conflict with the provisions of these regulations, and any such permit, certificate or license issued in conflict with the provisions of these regulations shall be null and void.

  • §2.03 Any person whether principal, agent, employee or otherwise, violating or causing or permitting the violation of any one of the provisions of these regulations shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $500.00 per violation or by imprisonment for not more than 6 months or by both such fine and imprisonment.

  • §2.04 Any building or use operated or maintained contrary to the provisions of these regulations shall be a public nuisance subject to injunction and abatement.

  • §2.05 The remedies provided herein shall be cumulative and not exclusive. §2.06 (This section amended by Ord. 07-01 on 2/12/07)The City Manager (or in his/her absence the Mayor), or his/her designee shall be responsible for the enforcement of the provisions of these regulations.   • §2.07 (Begin Section added by Ordinance 09-01 on 8/6/09) In the event that any fee or charge is not paid within the time period specified by the City, the City shall retain the right to seek enforcement and/or collection in court, at the expense of the responsible party. Expenses shall be recoverable by the City whether by assessment by the City Council following a hearing at a regularly scheduled City Council meeting or by a court of competent jurisdiction and shall further include the actual costs of collection such as staff time, administrative costs, court costs, attorneys’ fees and penalties.
