Section 907.6.6 – Monitoring, is amended in its entirety as follows:

907.6.6 Monitoring. Fire alarm systems required by this chapter or by the California Building Code shall be monitored by a Central Station Service (UUFX) that is listed in the current edition of the UL Online Certifications Directory unless otherwise required by the California Fire Code.
Combination Alarm Systems. Combination fire and burglar alarm systems are not permitted. Exception: Group R-3 and R-3.1.

Chapter 56

Explosives and Fireworks

Subsection 5601.1.6 is added to read as follows:

5601.1.6.1 Findings.

(a) The City Council finds that the sale, use and/or discharge of fireworks in the City of Fairfield, whether classified as "dangerous fireworks" and/or "safe and sane fireworks" (pursuant to Health and Safety Code Sections 12500 et seq.), will endanger life and property, and may encourage the use and/or discharge of fireworks in neighboring jurisdictions where their sale, use and/or discharge are prohibited unless prohibited and/or regulated as set forth in this chapter.
(b) The City Council also finds that the City of Fairfield, which is partially in both moderate, high, and very high Fire Hazard Severity Zones pursuant to Chapter 8B of the Fairfield Municipal Code ("FMC") and Government Code section 51178 , must prohibit and/or regulate fireworks in order to mitigate the risk of devastating wildfires which poses a grave threat to life, property, and community.

5601.1.6.2 Applicability of State Law.

(a) This chapter does not supersede State law, but is intended to supplement the provisions of Division 11, Part 2, of the Health and Safety Code (Sections 12500 et. seq.) and the administrative regulations adopted pursuant to law, and to prohibit and/or regulate by local authority, as authorized by Health and Safety Code Section 12541 , the sale, use, or discharge of fireworks in the City.
(b) If any part of this Chapter is determined by a Court or the State Legislature to be in conflict with State law, State law shall apply, but the remaining portions of this Chapter not in conflict with State law shall remain in full force and effect.

601.1.6.3 Definitions.

(a) "Citee" means any person served with an administrative citation charging them as a responsible person for violation. For purposes of this chapter, there may be more than one (1) responsible person for a violation. 5601.1.6.4 Fireworks Prohibited.

(a) The sale, purchase, possession, use, display, or discharge of dangerous fireworks or safe and sane fireworks by any person in the City of Fairfield is prohibited;

5601.1.6.5 Enforcement - Administrative Citation or Misdemeanor.

(a) A violation of this section shall be enforced with an administrative citation or as a misdemeanor, in the discretion of the code enforcement officer enforcing the violation;
(b) An administrative citation issued under this section shall be enforced according to the provisions of Chapter 1, Article II of the Fairfield Municipal Code;
(c) A misdemeanor violation of this section shall be punishable by a fine not exceeding $1,000 or by imprisonment in the county jail not to exceed six months, or by both such fine and imprisonment. The District Attorney or City Prosecutor may prosecute violations under this section;
(d) Each violation of this code, whether on the same day or different day, shall constitute a separate violation and shall be subject to separate enforcement;
(e) In addition to the issuance of an administrative citation or misdemeanor, the citee shall be required to abate the violation, including but not limited to taking steps to ensure the dangerous fireworks or safe and sane fireworks are rendered inert. Additionally, the citee shall immediately surrender all dangerous fireworks and safe and sane fireworks to the Code Enforcement Officers, law enforcement personnel, and/or fire personnel who issue the citation or make the arrest.

5601.1.6.6 Host Liability

(a) Except as may be permitted by state law or as provided in subsection (d), no host shall permit or fail to prevent the sale, purchase, possession, use, display, or discharge of any dangerous firework or safe and sane fireworks on the host's property, or on an adjacent public or private street or sidewalk, within the City of Fairfield;
(b) A host who permits or fails to prevent the sale, purchase, possession, use, display, or discharge of dangerous fireworks or safe and sane fireworks on a property under their possession or control, or on an adjacent public or private street or sidewalk, shall be deemed to have actual or constructive knowledge that dangerous fireworks have been discharged if the host has not taken all reasonable steps to prevent the discharge of dangerous fireworks;
(c) Where an administrative citation is issued to a host, there is a rebuttable presumption that the record owner of a private property, as shown on the County's latest equalized property taxes assessment rolls, and a lessee of the property has notice of any violation existing on or from said property; This presumption shall not apply where a host is cited or charged with a misdemeanor violation;
(d) The provisions of this section shall not apply to a host who initiates contact with a code enforcement officer, law enforcement or fire officials to report or assist in removing any person, dangerous fireworks, or safe and sane fireworks from the host's property or terminating the activity in order to comply with this chapter, if the request for assistance is made before a code enforcement officer, law enforcement, or fire official becomes aware of the situation.

5601.1.6.7 Appeals.

(a) Appeals of an administrative citation shall also be governed by the provisions of Chapter 1, Article II of the Fairfield Municipal Code;

Appendix D

Fire Apparatus Access Roads

Subsection D103.2 – Grade, is amended in its entirety as follows:

D103.2 Fire apparatus access roads shall not exceed 15 percent in grade. Exception: Grades steeper than 15 percent must be approved by the fire code official.

Subsection D103.6 – Signs, is amended in its entirety as follows:

D103.6 Signs. Where required by the fire code official, fire apparatus access roads shall be marked with permanent NO PARKING – FIRE LANE signs complying with Fair-field Fire Prevention Standard #01-24 – Designated Fire Lanes.

Subsection D107.1 – One- or two-family dwelling residential developments, is amended as follows:

D107.1 One- or two-family dwelling residential developments. Developments of one- or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access roads or approved by the fire code official.
