§ 5.16.010 MINIMUM LICENSE FEE.¶
The minimum annual license tax for every person carrying on, conducting or managing a business from a fixed place of business within the town shall be as set by resolution of the Town Council.

§ 5.16.020 RETAIL, SERVICE, WHOLESALE, MANUFACTURING AND MISCELLANEOUS.¶
(A) (1) Every person conducting, carrying on or maintaining a business consisting of selling at retail any goods, wares, merchandise or commodities, and any person conducting, carrying on or managing any of the following named businesses considered to be of a service nature, and other businesses or persons not listed which are considered to be of a service nature, and any person selling at wholesale, or by mail order, any goods, wares, merchandise or commodities, and any business conducting manufacturing, as defined in this Division I, and any business not specifically licensed by other provisions of this Division I shall pay an annual base license fee to be set by resolution of the Town Council, plus a fee based on the previous year’s gross receipts, which would include a combination of any or all of the titled businesses at a rate to be set by resolution of the Town Council.
(B) Service professions are considered to be the following:
(1) Alterations;
(2) Appliance repair;
(3) Artist;
(4) Auto painting;
(5) Auto repair service;
(6) Auto towing;
(7) Auto upholstering;
(8) Barber shop;
(9) Beauty shop;
(10) Bookkeeper or stenographer;
(11) Catering;
(12) Ceramics;
(13) Dressmaking;
(14) Janitorial service;
(15) Laundry;
(16) Machine shop;
(17) Music teachers;
(18) Newspapers;
(19) Tailors;
(20) Tree trimmers;
(21) Upholstering;
(22) Window cleaners; and
(23) Locksmith.

§ 5.16.030 PROFESSIONS, SEMI- PROFESSIONAL AND TRADE BUSINESSES.¶
(A) Every person conducting, carrying on or managing any of the following named professions, semi-professions or trade businesses from a fixed place of business within the town, and other businesses or persons not listed which are considered to be of a professional or semi-professional nature, shall pay an annual license fee for each person practicing his or her profession or trade. Such fee shall be set by resolution of the Town Council.
(B) Plus, he or she shall pay a fee per annum for each employee, also to be set by resolution of the Town Council.
(1) Accountant;
(2) Appraiser;
(3) Architect;
(4) Attorney;
(5) Auctioneer;
(6) Bacteriologist;
(7) Broker;
(8) Chemist;
(9) Chiropodist;
(10) Chiropractor;
(11) Collection agency;
(12) Credit bureau;
(13) Auditor;
(14) Dentist;
(15) Detective agency;
(16) Draftsperson;
(17) Doctor;
(18) Employment agency;
(19) Engineer;
(20) Finance company;
(21) Geologist;
(22) Income tax expert;
(23) Interior decorator;
(24) Laboratory;
(25) Lapidary;
(26) Optometrist;
(27) Orthopedist;
(28) Osteopath;
(29) Pathologist;
(30) Physician;
(31) Physiotherapist;
(32) Stone cutter;
(33) Surveyor;
(34) Title company;
(35) Urologist;
(36) Veterinarian;
(37) X-ray technician;
(38) Miscellaneous professions; and
(39) Family therapy.

§ 5.16.040 CONTRACTORS.¶
(A) Every person conducting, carrying on or engaging in business as a contractor not having a fixed place of business within the town shall pay a base annual license fee to be set by resolution of the Town Council.
(B) Subcontractors shall pay the base fee only unless a permit to do work is taken out in their name.
(C) Contractors who maintain a fixed place of business within the town shall pay a base fee per year, plus a set amount for each $1,000 of valuation for each construction job undertaken. The base fee for the businesses which commence after July l of any license year shall be prorated according to the provisions of § 5.12.100.

§ 5.16.050 FIRE, WRECK OR BANKRUPTCY SALES.¶
(A) Every person conducting, carrying on or managing a fire sale, wreck sale or bankruptcy sale shall pay a license tax in an amount to be set by resolution of the Town Council.
(B) (1) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BANKRUPTCY SALE. The sale of goods, wares and merchandise which have been previously purchased from a trustee or receiver in bankruptcy, or trustee or receiver in insolvency, or trustee for the benefit of creditors.
FIRE SALE or WRECK SALE. The sale of goods, wares and merchandise salvaged from a fire, wreck or other calamity.
(2) No license shall be required for the sale of merchandise salvaged from any fire, wreck or other calamity occurring in the town.

§ 5.16.060 HOME OCCUPATIONS.¶
Any person engaged in a home occupation, defined as a business conducted entirely within a dwelling and carried on exclusively and secondary to the use of the dwelling for dwelling purposes which does not change the character thereof, and in connection with which there is no display, no stock in trade, no outside storage of equipment and no commodity sold upon the premises, shall pay a business license fee to be set by resolution of the Town Council. Such uses as barbershop, animal hospital, beauty parlor and dancing school shall not be deemed to be home occupations.

§ 5.16.070 CHRISTMAS TREE SALES.¶
Every person conducting, carrying on or managing a business of selling Christmas trees, except where the business is conducted in connection with another regularly established place of business for which a license has been issued, shall pay an annual business license fee, in advance, for each location, to be set by resolution of the Town Council.

§ 5.16.080 CANVASSERS, PEDDLERS AND SOLICITORS.¶
Any person who does not maintain a fixed place of business within the town, who conducts, carries on or manages a business of canvassing, peddling or soliciting, shall pay a business license fee per day or an annual fee to be set by resolution of the Town Council.

§ 5.16.090 DELIVERY VEHICLES; NO FIXED PLACE OF BUSINESS.¶
Every person not having a fixed place of business within the town who delivers goods, wares or merchandise by vehicle, or who provides any services by the use of vehicles in the town, shall pay an annual license fee as set by resolution of the Town Council.

§ 5.16.100 MULTIPLE HOUSING.¶
(A) Every person owning, operating, leasing or otherwise in the business of multiple housing shall pay an annual business license fee as set by resolution of the Town Council.
(B) The unit occupied by the owner, in multiple residential units of less than five, is exempt from this provision.

§ 5.16.110 COIN-OPERATED VENDING MACHINES.¶
(A) Every person conducting, managing or carrying on a business of distributing, renting, leasing or placing of coin machines for public patronage in the town shall pay an annual license base fee, plus an amount for each machine over one, at rates set by resolution of the Town Council.
(B) Payment of individual license fee is the responsibility of the owner or operator of the business where the machine is installed; provided, however, the distributor of machines may pay all individual license fees for all machines installed in the town, if prior arrangements are made with the Town Clerk.
(C) Each coin machine placed, distributed or located in the town shall have affixed thereto, in printing, plainly visible to the public, the name, address and telephone number of the owner of the machine.

§ 5.16.120 PUBLIC DANCES.¶
(A) Every person or organization operating or carrying on public dances for which admission is charged, collected or received shall pay a license fee to be set by resolution of the Town Council, plus ten percent of gross receipts received.
(B) The above fee applies to every public dance held during the taxable year.
(C) (1) Any incidents requiring intervention of the Police Department will be sufficient cause to cancel dances and revoke licenses issued under this section.
(2) Any damage caused by the public dances shall be paid for by the person(s) operating or carrying on the public dances.

§ 5.16.130 REALTORS.¶
Every real estate broker conducting, carrying on or managing business consisting of the buying or selling or real estate within the town shall pay a license fee to be fixed from time to time by resolution of the Town Council.

§ 5.16.140 COMMERCIAL FILMING.¶
(A) The fees for commercial filming are to be fixed from time to time by resolution of the Council.
(B) Traffic control costs or any additional costs, as required by the Chief of Police, or any damages incurred to the town, shall be paid entirely by the applicant.

§ 5.16.150 PASSENGER VEHICLES FOR HIRE.¶
Every person engaged in the business of operating or conducting a taxicab, auto or bus for transportation of passengers shall pay a fee to be set from time to time by the Town Council.

§ 5.16.160 FIRE/BURGLAR ALARM INSTALLATION.¶
The license fee for fire/burglar alarm installation shall be set from time to time by resolution of the Town Council. In addition to certification by the Chief of Police, contractors installing fire alarm systems shall obtain a certification from the Fire Chief.

§ 5.16.170 STREET VENDORS.¶
(A) STREET VENDOR. Any person, whether or not having a fixed place of business For the conducting of which a license is required pursuant to other provisions of this title, engaging in the business of vending, selling or offering for sale any goods, wares or merchandise from any portable stand within the town.
(B) This requires a use permit.

§ 5.16.180 THEATERS.¶
Theaters maintaining a fixed place of business within the town shall pay an annual license fee, plus a fee on gross receipts in § 5.16.020 of this chapter, as set by resolution of the Town Council.
