Chapter 17.16 — HIGH DENSITY RESIDENTIAL – R-3 (ONE – 20 UNITS PER ACRE)

§ 17.16.010. Purpose.

This zone district is intended to provide areas for higher density apartment development. The zone district also allows professional office development.

§ 17.16.020. General plan consistency.

This zone district is consistent with the community residential land use designation. (Ord. 186, 2003)

§ 17.16.030. Density/intensity.

  • A. One to 20 housing units per gross acre.

  • B. Minimum parcel size: 7,200 square feet.

  • C. One family unit for each 2,000 square feet of lot area.

  • D. Maximum lot coverage – Residential uses: 75 percent.

  • E. Maximum lot coverage – Nonresidential uses: 75 percent. (Ord. 186, 2003; Ord. 216 § 3 (Att. A), 2015)

§ 17.16.040. Site development standards.

  • A. Setbacks.

    1. Front.

      • a. Home: 20 feet.

      • b. Garage or parking area: 20 feet.

      • c. Accessory building: Not permitted in front.

    2. Rear.

      • a. Home: 10 feet.

      • b. Garage or Parking Area.

        • i. Alley access: 10 feet.

        • ii. Other: 10 feet.

      • c. Accessory Building(s).

        • i. Not attached to main building(s): Five feet.

        • ii. Attached to main building(s): 10 feet.

    3. Side, interior: 10 feet.

  1. Side, exterior: Street side, 15 feet.
  • B. Building.

    1. Height: 45 feet.

    2. Height: Accessory, 20 feet.

    3. Distance between buildings: 10 feet.

  • C. Lot Dimensions (Minimum).

    1. Width:

      • a. Interior: 60 feet.

      • b. Exterior: 70 feet.

    2. Width, cul-de-sac: 60 feet at setback line.

    3. Depth, standard: 100 feet.

    4. Depth, cul-de-sac: 90 feet.

  • D. Parking.

    1. Single-Family, Duplex, Triplex or Townhouse Units.

      • a. Two parking spaces outside of any required setback. One parking space must be covered.

      • b. Parking stalls must be parallel and not tandem.

      • c. The parking areas and the driveway between the public street and the parking area must be covered in an all-weather surface (concrete, asphalt, bricks, etc.).

    2. Multiple-Family.

      • a. Two spaces per unit, with the exception of one-bedroom units, plus one space for every two dwelling units over three units;

      • b. One-bedroom units shall only be required to have one parking space per unit, plus one-half space for every two one-bedroom dwelling units over three units.

    3. Each required parking space shall have a minimum dimension of nine feet by 19 feet.

  • E. Signs. A single sign on each street frontage providing the name of the multifamily project, not exceeding 12 square feet in accordance with EMC § 17.34.190.

  • F. Eave Overhang. All single-family dwellings including manufactured homes shall have a minimum eave overhang of at least 16 inches. If the council finds a lesser overhang is the standard in the neighborhood, a minimum eave overhang consistent with the neighborhood standard shall be permitted.

§ 17.16.050. Permitted uses.

The following uses are permitted in the R-3 zone district subject to issuance of a building permit, business license or other required permit(s):

  • A. Single-family dwellings.

  • B. Duplex and triplex units.

  • C. Small group care home of clients pursuant to the California Health and Safety Code subject to review for overconcentration.

  • D. Small family day-care facilities.

  • E. Small agricultural employee housing.

  • F. Supportive housing.

  • G. Transitional housing.

§ 17.16.060. Accessory uses.

The following uses are permitted in the R-3 zone district as an accessory to the primary permitted or conditionally permitted use:

  • A. Garage or carport.

  • B. Swimming pool.

  • C. Fences, walls consistent with the provisions of EMC § 17.34.060.

  • D. Home occupation consistent with the provisions of EMC § 17.34.030.

  • E. Accessory dwelling units and junior accessory dwelling units consistent with the provisions of Chapter 17.52 EMC.

  • F. Usual and customary structures associated with a residence. (Ord. 186, 2003; Ord. 220 § 6, 2021)

§ 17.16.070. Conditional Uses

The following uses are permitted in the R-3 zone district upon approval and validation of a conditional use permit, in addition to any other permits or licenses required for the use. Setbacks and development criteria may be amended during the conditional use permit.

  • A. Townhouses or single-family attached.

  • B. Multiple-family apartments.

  • C. Professional offices.

  • D. Large family day-care facilities.

  • E. Places of Assembly or Learning.

  1. Churches, places of worship or spiritual assembly.

  2. Grange halls, community centers, meeting halls.

  3. Schools, public or private.

  • F. Public and Quasi-Public Facilities.

    1. Electrical substations.

    2. Fire, police or sheriff substation.

    3. Parks, picnic areas and playgrounds not associated with approved development.

    4. Water and wastewater treatment facilities.

  • G. Transient residential uses such as motels, hotels, bed and breakfasts, etc.

  • H. Buildings and structures taller than specified in EMC § 17.16.040(B).

  • I. Large group care home of clients pursuant to the California Health and Safety Code subject to review for overconcentration.

  • J. Senior care facility.

  • K. Single-room occupancy housing. The unit may have a kitchen or bath facilities, but not both in the same room.

  • L. Other uses similar to those listed in this section.
