El Cerrito Municipal Code Ch. 1.01 Code Adoption

The El Cerrito Municipal Code together with those secondary codes adopted by reference as authorized by the California State Legislature is hereby adopted. Portions of the secondary codes are deleted or modified by the provisions of the El Cerrito Municipal Code.

This code shall be known as the "El Cerrito Municipal Code." It shall be sufficient to refer to said code as the El Cerrito Municipal Code in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. It shall be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part thereof as an addition to, amendment to, correction or repeal of the El Cerrito Municipal Code. Further reference may be made to the titles, chapters, sections and subsections of the El Cerrito Municipal Code and such references shall apply to that numbered title, chapter, section or subsection as it appears in the code.

This code consists of all the regulatory, and penal, ordinances and certain of the administrative ordinances of the city of El Cerrito, California, and is codified pursuant to the provisions of Sections 50022.1 through 50022.8 and 50022.10 of the Government Code.

Whenever a reference is made to this code as the El Cerrito Municipal Code, or to any portion thereof, or to any ordinance of the city, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made.

Title, chapter and section headings contained herein shall not govern, limit, modify or in any manner affect the scope, meaning or intent of the provision of any title, chapter or section hereof.

The provisions of this code shall not affect matters of record which refer to ordinances designated by a number included within the code. Such reference by number shall apply to the corresponding provisions contained within this code. (Ord 89-4 (part), 1989: Ord. 397 N.S. § 7, 1976.)

Prosecution for violation of ordinances committed prior to the effective date of this code shall not be affected by the adoption of the code or by repeal or amendment of such ordinances.

Neither the adoption of this code nor repeal or amendment of any ordinance shall be construed as a waiver of any license or penalty due and unpaid under such ordinance at the effective date of the code; nor shall such adoption or repeal be construed as affecting any provision of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to the violation thereof.

Neither the adoption of this code nor the repeal or amendment of any ordinance shall affect the validity of any bond or deposit required to be posted, or deposited pursuant to such ordinance; and all rights and obligations thereunder shall continue in full force and effect.

If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code.

This code shall become effective on the date the ordinance codified in this chapter and adopting this code as the El Cerrito Municipal Code becomes effective.
