§ 9.41.010. Intent and purpose.

It is the intent of the City Council in enacting this chapter to adopt a limited prohibition against targeted picketing which shall be construed and applied in accordance with the interpretation given to a similar ordinance by the United States Supreme Court in Frisby v. Schultz, 487 U.S. 474 (1988). Section 9.41.020 shall only prohibit picketing focused on and taking place in front of a particular residence. The limited purpose of the prohibition is to preclude intrusion upon the constitutionally protected privacy rights of the targeted resident.

§ 9.41.020. Picketing private residence prohibited.

It is unlawful for any person to engage in picketing before or about the residence or dwelling of any individual in the City of El Cajon.

A. For purposes of this section, the term "residential dwelling" means any permanent building being used by its occupants solely for nontransient residential uses.

B. For purposes of this section, the term "targeted picketing" means picketing activity that is targeted at a particular residential dwelling and proceeds in a location or on a definite course or route in front of or immediately adjacent to that particular residential dwelling.

C. This section does not and shall not be interpreted to preclude picketing in a residential area that is not targeted at a particular residential dwelling.
