§ 13.40.010. Definitions.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

"Cesspool," "septic tank" and "seepage pit"

mean all manner of sewage disposals other than regular sewage disposal plants and systems operated by a political subdivision and holding a valid permit from the State Department of Public Health.

"Health officer"

means the health officer or any sanitary inspector regularly employed by the city health department.

§ 13.40.020. Examinations—Conducted by county health officer.

The examination for cesspool or septic tank cleaners shall be conducted by the county health officer as provided in Section 25004 of the Health and Safety Code of the state.

§ 13.40.030. Examination—Fee—Penalties for late payment.

Whenever any person not previously registered applies for examination as a septic tank or cesspool cleaner, he shall pay to the health officer or his duly authorized representative, an examination fee as set pursuant to Section 8.36.070 of the El Cajon Municipal Code. In the event the applicant is unsuccessful in such examination, no part of such examination fee shall be returned to the applicant.

In any case where the applicant has failed for a period of thirty days after the time required, to apply for the examination and pay the examination fee required by this section, there shall be added to and collected with the examination fee a penalty equal to ten percent of the fee; and for each additional month or fraction of a month after the expiration of such thirty-day period that the applicant fails to make such application and pay said fee, there shall be added to and collected with the examination fee an additional penalty equal to ten percent of the fee; provided, however, in no event shall the total penalty added to the examination fee pursuant to this section be more than sixty percent of the examination fee. The imposition of or payment of the penalty imposed by this section shall not prevent the imposition of any other penalty prescribed for violation of this code.

§ 13.40.040. Annual registration fees—Penalties for delinquent fees.

In addition to the examination fee provided in Section 13.40.030, and set pursuant to Section 8.36.070 of this code, there is imposed an annual registration fee, also set pursuant to Section 8.36.070 of this code, upon each person registered as a septic tank or cesspool cleaner under the provisions of Chapter 6, Division 20 of the Health and Safety Code of the state of California. Said registration fee shall be paid to the health officer, or his duly authorized representative.

A registration issued pursuant to this section shall expire on the last day of the month of the one year anniversary month in which the registration was issued, and shall be renewed annually. The annual registration fee, if unpaid, is delinquent on the first day of the second month after the month in which the registration expires, and thereafter a penalty equal to ten percent of the annual fee shall be added thereto and shall be collected at the time application for renewal is made.

If the annual fee and penalty is not paid the first month after it is due there shall be added to and collected with the annual fee an additional penalty equal to ten percent of the annual fee for each month or fraction of a month during which the annual fee or any penalty continues to remain unpaid; provided, however, that in no event shall the total penalty added to the annual fee pursuant to this section be more than sixty percent of the annual fee. The imposition of or payment of the penalty imposed by this section shall not prevent the imposition of any other penalty prescribed by this code, or any ordinance, or prosecution for violation of this code, or any ordinance.

§ 13.40.050. Inspection of equipment—Registration fee for sewage pumping vehicle.

The health officer shall examine all equipment used in processing septic tanks, cesspools and seepage pits owned or under the control of each person registered under the provisions of this chapter at regular intervals not to exceed ninety days after a permit is granted.

There is hereby imposed an annual registration fee, set pursuant to Section 8.36.070 of the El Cajon Municipal Code, for each sewage pumping vehicle. Said fee shall be paid to the health officer or his duly authorized representative. Renewals and penalties for delinquency shall be made as set forth in Section 13.40.040 of this code.

§ 13.40.060. Cleaning cesspools and septic tanks—Report to health officer.

Whenever a person cleans a septic tank or cesspool, he shall notify the health officer or his duly authorized representative upon the regulation form adopted by the health officer. Such report shall be transmitted to the department of public health at the close of each day.

§ 13.40.070. Cleaning cesspools and septic tanks—Report contents.

The form for the report to the health officer, of septic tanks and cesspools cleaned, shall contain information such as the location of septic tanks, cesspools and seepage pits, location of the disposal field where sewage effluent or other material has been finally disposed of, or any other information which the health officer may, by regulation, require.
