Chapter 10.54 — ENGINE-BRAKING PROHIBITION

Sec. 10.54.010. - Purpose.

The purpose of this chapter is to prohibit the loud, excessive, unusual, disruptive, or explosive use of engine retarding and compressed air-braking devices within the city's jurisdiction.

Sec. 10.54.020. - Definitions.

The following words, terms and, phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Engine retarding brake means any engine retarding brake system that is designed to support or assist in the deceleration, decompression, or braking of any motor vehicle that results in the excessive, loud, unusual, or explosive noise from such vehicle.

Motor vehicle means a vehicle as defined in Vehicle Code Section 415.

Sec. 10.54.030. - Prohibited acts.

It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated on designated truck routes within the city's jurisdiction any engine retarding brake designed to support or assist in the braking or deceleration of any motor vehicle that results in loud, excessive, unusual, disruptive, or explosive noise from such motor vehicle.

Sec. 10.54.040. - Exemptions.

The provisions of this section shall not apply to the application of unmuffled compression brakes where necessary for the protection of persons and/or property which cannot be avoided by application of an alternative braking system. Sounds created by emergency motor vehicles for emergency purposes are also exempt.

Sec. 10.54.050. - Sign posting.

Signs stating "No Engine Brake" or "Engine Brake Ordinance Enforced" may be installed at locations deemed appropriate to advise motorists of the prohibitions contained in this chapter.

Sec. 10.54.060. - Penalties.

It is unlawful for any person to violation any provision of this chapter. Any person violating any provision of this chapter shall be deemed guilty of an infraction or misdemeanor as hereinafter specified.

Any person so convicted shall be guilty of an infraction offense and punished by a fine not exceeding:

•  $100.00 for a first violation;

•  $200.00 for a second violation;

•  For the third and any additional violations shall constitute a misdemeanor offense and shall be punishable by a fine not exceeding $1,000.00 or six months in jail, or both.
