8.44.200 - Definitions.

"Health officer" means the East Palo Alto city health officer or his/her authorized representative.

"Individual sewage disposal system" means and includes any system of piping, treatment devices or other facilities (excluding chemical toilets) that stores, conveys, treats or disposes of sewage which is discharged into other than a public sewer system. A septic tank system is included in this definition of an individual sewage disposal system.

"Person" means and includes any person, firm, association, corporation or any members, agents or employees of the foregoing.

8.44.210 - Certificate of inspection.

Following the completion of an individual sewage disposal system in accordance with the provisions of Sections 8.44.010 through 8.44.110 of this code and payment of the normal septic tank permit fees, a certificate of inspection shall be issued by the health officer. The certificate of inspection shall be valid for three years.

The preceding provisions of this section shall not apply to septic tank systems granted an exemption to the prohibition contained in Resolution 76-7 of the California Regional Water Quality Control Board, San Francisco Bay Region, dated April 20, 1976. The owners of those septic tank systems must furnish one of the following to the health officer no later than March 1, 1981:

A. Proof that the septic tank has been pumped by a licensed septic tank pumper within the three year period immediately preceding March 1, 1981; or

B. Proof satisfactory to the health officer that such pumping is not necessary for the protection of public health, safety and welfare.

Upon receipt of the necessary proof, a certificate of inspection shall be issued by the health officer. The certificate of inspection shall be valid for three years.

8.44.220 - Triennial inspection and renewal.

Every individual sewage disposal system shall be subject to a triennial inspection by the health officer to assure its continued proper functioning and for the purpose of renewing the certificate of inspection for a three-year period when the following conditions have been met:

A. A report of inspection of the individual disposal system by the health officer indicates that the system is operating in a satisfactory manner.

B. Proof of septic tank pumping by a licensed septic tank pumper is submitted, when such pumping is required by the report of the health officer.

C. Proof of repairs or alterations to an individual sewage disposal system is submitted, when such repairs have been required by the report of the health officer.

D. Payment of a fifty dollars ($50.00) renewal fee is made to the city health department.

8.44.230 - Defective systems.

Following the triennial inspection covered above, if an individual sewage disposal system is found to be defective, the prior certificate of inspection may be extended for a period not to exceed six months beyond its normal expiration date, provided that corrective measures as recommended by the health officer are being undertaken.

8.44.240 - Revocation of certificate of inspection.

The health officer may revoke any certificate issued hereunder if he/she determines that the individual sewage disposal system does not comply with the provisions of this code, any regulations issued thereunder, or the conditions of the certificate.
