8.04.010 - Declaration of findings.

The city council of the city does find and declare as follows:

A. That the expenses incurred by the city health officer in the enforcement of certain statutes, orders, quarantines, rules and/or regulations prescribed by state officers or departments relating to public health, are not met by any fees prescribed by the state;

B. That the expenses incurred by the city health officer in the enforcement of such statutes, orders, quarantines, rules or regulations and in providing certain other related services are reasonable and necessary therefor; and

C. That the schedules of fees prescribed in this chapter reflect the expenses of the city health officer for such enforcement and in providing such services.

8.04.020 - Purpose and authority.

The purpose of this chapter is to establish fee systems for certain businesses, activities, and property alterations and uses, specified below, which are subject to state statutes, orders, quarantines, rules or regulations relating to public health, in order to reimburse the expenses of the city health officer in enforcing such statutes, orders, quarantines, rules or regulations. Section 510 of the California Health and Safety Code grants authority to the city to fulfill the purpose of this chapter.

8.04.030 - Scope and application.

The fees prescribed in Section 8.04.080 of this chapter apply to any business or activity as defined in Section 8.04.010 of this chapter, which is within the geographic area in which the city health officer is responsible for enforcing state statutes, orders, quarantines, rules or regulations relating to the public health and to any property alteration or use, as defined in this chapter, which occurs in the city.

8.04.040 - Responsibility for inspection and collection.

The city department of health shall be responsible for the inspection both of the businesses and activities defined in this chapter. The finance director shall be responsible for collection of the fees prescribed by Sections 8.04.080.

8.04.050 - City health officer.

The term "city health officer" means the director of health of the city or his/her duly authorized representative.
