8.12.010 - Sound devices—Excessive noise.

A. No person shall operate any vehicle radios or stereo or other radio, stereo, or amplified sound device in such a manner that excessive, unnecessary, or unusually loud noise emanates from it and annoys, disturbs, injures, or endangers the comfort, repose, health, peace or safety of others. Violation of this section is prohibited and constitutes an infraction.

B. The standards which shall be considered in determining whether a violation of this section exists shall include but not be limited to the following:

  1. The volume of the noise;

  2. The intensity of the noise;

  3. Complaints by citizens;

  4. Distance from which the noise can be heard.

The operation of any such sound device in such a manner as to be plainly audible at a distance of one hundred (100) feet from the device or its speakers shall be prima facie evidence of a violation of the section.

C. Exemptions. This section shall not prohibit the operation of emergency vehicles, law enforcement functions, other authorized city functions, utility trucks, sound systems used in parades or other special events, or necessary use of auto horns and truck backup warning signals. The city council may upon its own motion or through an application process grant other exemptions.
