15.12.010 Uniform fire code adopted.

There is adopted by the city of Dorris for the purpose of prescribing regulations gov- erning conditions hazardous to life and prop- erty from fire or explosions, that certain code known as the Uniform Fire Code recom- mended by the Western Fire Chiefs Associa- tion and the International Conference of Building Officials being particularly the 1976 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by Section 1512.070 of which code not less than three 172 copies have been and are now filed in the of- fice of the clerk of the city of Dorris and the same are adopted and incorporated as fully as if set out at length herein, and from the date on which the ordinance codified in this chap- ter takes effect, the provision thereof shall be controlling within the limits of the city of Dorris. 15.12.020 Bureau of fire prevention-

Established-Duties. A. The Uniform Fire Code shall be en- forced by the bureau of fire prevention in the frre department of the city which is estab- lished and which shall be operated under the supervision of the chief of the fire depart- ment. B. The chief (or fire marshal) in charge of the bureau of fire prevention shall be ap- pointed by the city council, on the basis of examination to determine his or her qualifica- tions. C. The chief of the fire department may detail such members of the fire department as inspectors as shall from time to time be nec- essary. The chief of the fire department shall recommend to the city council the employ- ment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and nonmembers of the fire department, and appointments made after examination shall be for an indefmite term with removal only for cause. 15.12.030 Definitions.

A. Wherever the word ''jurisdiction" is used in the Uniform Fire Code, it means the city of Dorris. B. Wherever the term "corporation coun- cil" is used in the Uniform Fire Code, it means the attorney for the city of Dorris. (Ord. 166 § 3, 1980)

15.12.040 Storage of flammable or

combustible liquids in outside aboveground tanks- Limits established. A. The limits referred to in Section 1S.201 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited, are established as follows: Refer to Section 1S.201 of the Uniform Fire Code. B. The limits referred to in Section 1S.601 of the Uniform Fire Code, in which new bulk plants for flammable or combusti- ble liquids are prohibited, are established as follows: Refer to Section 15.601 of the Uni- form Fire Code. 15.12.050 Bulk storage of liquefied

petroleum gases-Limits established. The limits referred to in Section 20.1 OS (a) of the Uniform Fire Code, in which bulk stor- age of liquefied petroleum gas is restricted, are established as follows: Refer to Section 20.1 OS (a) of the Uniform Fire Code. (Ord. 166 § S, 1980)

15.12.060 Storage of explosives and

blasting agents-Limits established. The limits referred to in Section 11.1 06(b) of the Uniform Fire Code, in which storage of 173 explosives and blasting agents is prohibited, are established as follows: Refer to Section 11.106 ofthe Uniform Fire Code. (Ord. 166 § 6, 1980)

15.12.070 Amendments to Uniform Fire

Code. The Uniform Fire Code can be amended and changed in the following respects by sec- tion, paragraphs, or city resolution or state law. (Ord. 166 § 7, 1980)

15.12.080 Appeals.

Whenever the chief shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been miscon- strued or wrongly interpreted, the applicant may appeal from the decision of the chief to the city council, within thirty (30) days from the date of the decision appealed. (Ord. 166 § 8, 1980)

15.12.090 New materials, processes or

occupancies which may require permits. The city council, the chief and the chief of the bureau of fire prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occu- pancies, which shall require permits, in addi- tion to those now enumerated in such code. The chief of the bureau of fire prevention shall post such list in a conspicuous place in his or her office and distribute copies thereof to interested persons. (Ord. 166 § 9, 1980)

15.12.100 Violation-Penalty.

A. Any person who shall violate any of the provisions of this code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made there- under, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as af- firmed or modified by the bureau of fire pre- vention or by a court of competent jurisdic- tion, within the time fixed herein, shall sever- ally for each and every such violation and · noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) or by imprison- ment for not less than ninety (90) days or by both such fine and imprisonment. The impo- sition of one penalty for any violation shall not excuse the violation or permit it to con- tinue and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not oth- erwise specified, each ten (10) days that pro- hibited conditions are maintained shall con- stitute a separate offense. B. The application of the above penalty shall not be held to prevent the enforced re- moval of prohibited conditions. (Ord. 166 § 10, 1980) 174
