1.16.010 Violations.

It is unlawful for any person to violate any provision or to fail to comply with any require- ments of this code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor, unless the offense is specifically classified in this code or by state law as an infraction, or the city attorney reduces the charge to an infraction, in which case the person shall be guilty of an infraction. Each day that any condition caused or permitted to exist in violation of this code continues shall consti- tute a new and separate violation and offense. (Ord. 201 (part), 2003)

1.16.020 Penalty.

A. Any person convicted of a misdemeanor under the provisions of this code, unless provi- sion is otherwise made in this code, shall be punishable by a fine of not more than one thou- sand dollars ($1,000.00) or by imprisonment in the county jail for a period not more than six months, or by both such fine and imprison- ment. B. Any person convicted of an infraction of the provisions of this code, unless provision is otherwise made in this code, shall be punish- able upon a first conviction by a fine of not more than one hundred dollars ($100.00), and for a second conviction within a period of one year by a fine of not more than two hundred dollars ($200.00), and for a third or any subse- quent conviction within a period of one year by a fine of not more than five hundred dollars ($500.00). C. A bail schedule for parking violations shall be adopted by the city council and amended from time to time by resolution. (Ord. 201 (part), 2003)

1.16.030 Continuing offenses.

Each person convicted of a misdemeanor or infraction under the provisions of this code shall be guilty of a separate offense for each and every day during any portion of which any vio- lation of any provision of this code is commit- ted, continued or permitted by the person, and shall be punished accordingly.
