Whenever any person fails or refuses to perform any act required by division 4 or 5 of this chapter, the board may proceed as provided in Government Code § 50230 et seq.

Whenever Government Code § 50236 or any other provision in the article in which such section is located refers to excavations covered by this chapter but not abandoned and swimming pools, the appropriate word or words "excavation," "swimming pool," or other appropriate word or words shall be substituted.

(a) Referee appointed by board; exception. Except in the case of an abandoned excavation, as defined by Government Code § 50230, the board may appoint a referee to hold any hearing required by this chapter.

(b) Compensation of referee. If the board appoints a county officer or county employee to act as referee, all time spent as a referee shall be considered as time spent by such officer or employee at performing the duties of his position. His compensation for performing both the duties of his position and as referee shall be at the rate of compensation provided for by ordinance.

(c) Board action on referee recommendations. Where a referee has held a hearing pursuant to this chapter, the board may act upon the findings and recommendations of the referee.
