Sec. 10.24.010. - Chapter provisions and statutory provisions.

The regulations in this chapter are in addition to those in Vehicle Code § 39000 et seq. This chapter shall be construed consistently with the provisions of such statute.

Sec. 10.24.020. - Registration and licensing requirements.

A person shall not operate or permit to be operated on any highway in the city any bicycle propelled wholly or in part by muscular power, the owner of which bicycle is a resident of the city, unless and until such bicycle is registered with the sheriff and licensed, and the license is attached to the bicycle as provided in this chapter.

Sec. 10.24.030. - Application requirements; renewal fee.

(a) The applicant for the registration and licensing of a bicycle shall make application therefor, accompanied by a fee of $2.00, upon forms provided for by that officer. Such form shall show:

(1) The name and address of the applicant;

(2) A description of the bicycle to be registered and licensed, including the serial number of the bicycle, if any, make of bicycle, type of bicycle, mode of bicycle and the color thereof; and

(3) Such other information or description as the sheriff may require.

(b) For each bicycle license renewal, a fee of $2.00 shall be collected.

Sec. 10.24.040. - Issuance of registration, license and license indicia.

(a) Upon receipt of an application in full compliance with section 10.24.030, plus the fee of $2.00, the sheriff shall:

(1) Register the bicycle in a permanent register maintained by him;

(2) Issue to the applicant a registration certificate;

(3) Issue to the applicant a license indicia in the form designated by the director of motor vehicles; and

(4) Attach to the front of the seat tube of the bicycle frame the license indicia.

(b) Both the registration certificate and the license bear the registration number assigned.

Sec. 10.24.050. - License indicia provided by tax collector.

The tax collector shall provide the sheriff, for each bicycle licensed pursuant to the provisions of this chapter, a license indicia distributed to the city by the department of motor vehicles.

Sec. 10.24.060. - Renewal.

(a) Bicycle licenses shall be renewed on January 1 of the third year following the year of registration. Renewal shall be indicated by a supplementary adhesive device affixed parallel to the above or below the indicia with expiration date shown.

(b) Bicycle licenses which have been issued pursuant to this chapter shall remain valid until their assigned expiration dates.

Sec. 10.24.070. - Transferring license indicia.

A person shall not transfer and a person shall not cause or permit to be transferred any bicycle license indicia issued pursuant to this chapter to any bicycle for which the license indicia was not issued.

Sec. 10.24.080. - Sale or change of ownership; transfer of registration and license; fee.

(a) Any person who is the owner of a bicycle, whether licensed pursuant to the provisions of this chapter or unlicensed, who sells or otherwise disposes of a bicycle, except a new bicycle or new bicycle frame, whether in the course of business or otherwise, shall within ten days thereafter:

(1) Endorse upon the registration certificate previously issued for such bicycle a written transfer of same, setting forth the name, address, telephone number of the transferee, date of transfer, and signature of the transferer; and shall deliver the registration certificate, so endorsed, to the sheriff.

(2) If a registration card has been issued to the owner, he shall return such registration card to the sheriff.

(b) Any person who purchases or otherwise acquires possession of a bicycle shall, within ten days of taking possession, apply for the transfer of license to his name as provided for in this chapter.

(c) For each transfer of registration certificate, a fee of $1.00 shall be collected.

Sec. 10.24.090. - Lost license indicia; reregistration; changes of address.

(a) If the license indicia is lost, stolen or mutilated, the person owning such bicycle shall make an application to reregister such bicycle. The applicant shall pay a fee of $1.00 and procure from the sheriff a new license indicia. The sheriff shall cancel the registration on such bicycle in the permanent register, shall reregister such bicycle, and, if necessary, give to such bicycle a new identifying number.

(b) Whenever the owner of a licensed bicycle changes his address he shall, within ten days, notify the sheriff's department of the old and new address.

Sec. 10.24.100. - Removing or changing frame number or license indicia.

(a) A person shall not wilfully remove, destroy, mutilate or alter, or cause or permit to be removed, destroyed, mutilated or altered the number on any bicycle frame for which any such registration shall have been made pursuant to the provisions of this chapter.

(b) A person shall not remove, destroy, mutilate or alter, or cause or permit to be removed, destroyed, mutilated or altered any license indicia issued pursuant to this chapter for any such bicycle or registration certificate relating to such bicycle during the time in which such license indicia or registration certificate is operative; provided, however, that nothing in this chapter shall be deemed or construed to prohibit the sheriff from stamping any number on any such bicycle for identification purposes.

Sec. 10.24.110. - Reports from bicycle dealers, auctioneers and other businesses…

(a) Every auctioneer, auto wrecker, foundry, pawnbroker, secondhand dealer, junk dealer or bicycle dealer shall notify the sheriff in writing, on forms prescribed by the sheriff, not less often than once a week of every bicycle received in the course of business by him since his last report. In such reports he shall describe each such bicycle and give the license number thereof, if any. In addition, he shall supply such other information as the sheriff may require.

(b) This section requires such a report even if the receipt of such bicycle also has been reported pursuant to division 5 of chapter 5.120.

An auctioneer, auto wrecker, foundry, pawnbroker, secondhand dealer, junk dealer or bicycle dealer receiving any bicycle in the course of business shall not sell, transfer, deliver, destroy or alter any such bicycle until 14 days after its receipt has been reported to the sheriff.

Sec. 10.24.130. - Penalty for violation of chapter.

Any violation of any of the provisions of this chapter by any person shall be an infraction, punishable by a fine of not more than $5.00.
