9.16.010 - Enforcement authority.

The director of parks and recreation shall see to the enforcement of all ordinances relating to all parks within the corporate limits of the city. He shall enforce all rules relating to the use of each and every park within the city limits.

9.16.020 - Violation of regulations unlawful.

It is unlawful for any person to violate any regulation governing conduct in any public park within the city limits.

9.16.030 - Consent required for amusement for gain.

No amusement for gain or for which a charge is made can be conducted in a park without the consent of the city council of the city.

9.16.040 - Permit required for organized assemblies.

A. No person shall engage in, participate in, aid, form, or organize any assembly or group of people or make any speeches or conduct any musical program or festivals in any park, unless a permit has been obtained from the director of parks and recreation, and unless such permit is carried by the person heading or leading such activity; provided, however, that the provisions hereof shall not apply to students' work when constituting a part of their educational activities and under the immediate direction and supervision of the proper school authority; nor to any governmental agency within the scope of its functions.

B. An application for such a permit shall be filed with the director of parks and recreation not less than seventy-two hours prior to the proposed use; and the director of parks and recreation shall make a determination thereon within twenty-four hours prior to such use.

9.16.050 - Prohibited acts.

It is unlawful for any person, firm or corporation using such parks to either perform or permit to be performed any of the following acts:

A. Willfully mark, deface, disfigure, injure, tamper with, or displace or remove, any building, tables, benches, fireplaces, paving or paving material, water lines, trash receptacle, or any other public utility or parts or appurtenances thereof; signs, notices or placards whether temporary or permanent, or any boundary markers; or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal;

B. Throw, discharge, or otherwise place or cause to be placed in any fountain, washbasin or latrine, any substance or thing, liquid or solid, which will or may result in the pollution or destruction thereof;

C. Bring in or dump, deposit, or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse; or other trash. No such refuse or trash shall be placed or left anywhere on the grounds of the park but shall be placed in the proper receptacles where these are provided; where the receptacles are not so provided, all such rubbish or wastes shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere;

D. Disturb the peace or use any profane, obscene or blasphemous language;

E. Endanger the safety of any person by any conduct or act;

F. Commit any assault, battery, or engage in fighting;

G. Violate any rules for the use of the park made or approved by the director of parks and recreation, the city manager, or the city council;

H. Prevent any person from using any park or any of its facilities, or interfere with such use in compliance with this chapter and the rules applicable for such use.

I. Camping or lodging within any public park as defined by and in accordance with the provisions of Chapter 9.38 of Title 9, Subsection V of this Code, except by permission in writing from the city council.

9.16.055 - "Drug-free" zones.

The city designates the following city parks as "drug-free zones" for the purpose of sentence enhancement pursuant to California Health and Safety Code Section 11380.5, as amended:

A. Morningside Park. 20th/Morningside Drive.

B. Jefferson Park. 6th/Jefferson.

C. Cesar Chazvez Park. 9th/Ellington.

D. Valley Vista Park. 300 Block Belmont.

E. Albany Park. 20th/Albany.

F. Kalibo Park. 22nd/Lupine.

G. Cecil Avenue. Cecil/Madison.

H. Almond Tree Park. Westend/11th Ave.

I. Delano Soccer Park. 1100 Block Stradley Ave.

J. Delano Heritage Park. 330 South Lexington Street.

9.16.060 - Picnics in designated locations.

No person in a park shall picnic or lunch in a place other than those designated for that purpose. No person in a park shall use any portion of the picnic areas or any of the buildings or structures therein for the purpose of holding picnics to the exclusion of other persons or shall any person use such facilities for an unreasonable time if the facilities are crowded.

9.16.070 - Vehicle restrictions.

It is unlawful to drive or park any automobile except on a street, driveway or parking lot in any park; or to park or leave any motorized vehicle in any place other than the one established for public parking.

9.16.080 - Dangerous animals prohibited.

It is unlawful to bring any dangerous animal into any park.

9.16.090 - Permit required for vending.

It is unlawful for any person, other than those issued a permit by the director of parks and recreation, or by the city council, or any of the city council delegated city officials, to vend, sell, peddle or offer for sale any commodity or article within park.

9.16.100 - Sign regulations.

It is unlawful for anyone to place, glue, tack or otherwise post any sign, placard, advertisement, or inscription whatever, nor shall any person erect or cause to be erected any sign whatever on any public lands on any part of the park or roads adjacent to the park; except for any properly authorized government official in pursuit of any official duty.

9.16.110 - Hours of operation.

A. All public parks within the city shall be open daily to the public, year around, from the hour of six a.m. to the hour of ten p.m.; and it is unlawful for any person or persons (other than city personnel or other governmental authority conducting appropriate city or governmental business therein), to occupy or be present in the park during any hours in which the park is not open to the public.

B. Any section or part of the park may be declared closed to the public by the director of parks and recreation at any time and for any interval of time, either temporarily or at regular or stated intervals.

9.16.112 - Definition.

"Skateboard park" means the fenced in area in south Cecil Park, which is designated for the use of skateboards, rollerblades, in-line skates and roller skates only.

9.16.114 - Use of safety equipment.

A. It is unlawful for any person to utilize the skateboard park unless that person is wearing a helmet, elbow pads, knee pads and appropriate footwear (no sandals, open toed footwear or bare feet).

B. Any person who fails or refuses to comply with this section or any other rules covering the skateboard park or who is injured while using the skateboard park shall be deemed negligent.

9.16.116 - Rules.

A. It is unlawful for any person to violate any rule adopted by the city and posted at the skateboard park under this section.

B. The city adopts the following rules for the use of the skateboard park:

  1. Only skateboards, in-line roller skates, roller blades and roller skates are permitted in the skateboard park.

  2. Hours of use shall be from eight a.m. to dusk, on days the park is open. Use at any other time shall be considered trespassing.

  3. Amplified music is not permitted.

  4. Graffiti, tagging or other means of defacing city property is strictly prohibited.

  5. Alcohol, animals, coolers, drugs, food, gum, smoking and tobacco products and glass containers are prohibited in skateboard park.

  6. Waxing of any surface of the skateboard park is prohibited.

  7. Profanity or other inappropriate language is prohibited.

  8. No use is permitted when wet or raining.

  9. Additional obstacles or other materials (ramps/jumps) may not be brought into the skateboard park nor shall any existing feature, such as ramps, be modified.

  10. Use is prohibited if a hazardous condition exists.

  11. Organized events must be approved by the community services director.

9.16.118 - Posting of rules.

The community services department shall cause a sign or signs to be posted in English and Spanish at all such skateboard parks or facilities providing reasonable notice stating that any person failing to comply with the skateboard park rules shall be guilty of an infraction of the skateboard park rules and subject to citation.

9.16.120 - Violation—Penalty.

Any person convicted of violating Sections 9.16.112 through 9.16.118 of this chapter is guilty of an infraction, and upon conviction thereof shall be punished by a fine of fifty dollars for the first offense; a fine of one hundred dollars for the second offense; and a fine of one hundred fifty dollars for each additional offense.
