1.19.010 - Definitions and rules of construction.

For purposes of this Chapter, the following definitions shall apply:

City means the City of Del Rey Oaks.

Code or municipal code means the City of Del Rey Oaks Municipal Code.

Computation of time means the time in which any act provided by law is to be done is computed by excluding the first day and including the last, unless the last day is a holiday and then it is also excluded.

City Council or Council means the City Council of the City of Del Rey Oaks.

Day means the period of time between any midnight and the midnight following.

Daytime is the period of time between sunrise and sunset. Nighttime is the period of time between sunset and sunrise.

Enforcement Officer means any City employee, contractor, or agent of the City with the authority to enforce any provision of this code. The City Manager shall designate the Enforcement Officer.

Hearing Officer means Administrative Enforcement Hearing Officer pursuant to Article 5 of this Chapter.

Month means a calendar month.

Number. The singular number includes the plural and the plural the singular.

Owner, applied to a building or land, includes any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or of a part of such building or land.

Person includes any person, firm, association, organization, partnership, business trust, corporation or company.

Personal property includes every species of property, except real property.

Property includes real and personal property.

Real property includes lands, tenements, and hereditament.

Shall, may. "Shall" is mandatory and "may" is permissive.

Tenant or occupant. The words "tenant" or "occupant," applied to a building or land, shall include any person holding a written or an oral lease of, or who occupies the whole or a part of such building or land, either alone or with others.

Week. A week consists of seven consecutive days.

Year. The word "year" shall mean a calendar year, except where otherwise provided.

1.19.020 - Administrative citation.

The administrative citations process set forth in this Chapter may be utilized for municipal code or ordinance violations the City deems minor or transient in nature. For example, and not by exclusion, to enforce violations of this code that pertain to signs, yard waste, false alarms, noise issues, vehicle parking, and minor or nonrecurring violations of building, plumbing, electrical, or other similar structural or zoning issues.

1.19.030 - Administrative compliance order.

The administrative compliance order process generally addresses municipal code and ordinance violations the City deems serious, continuing, or recurring.

1.19.040 - Non-exclusivity.

A. This Chapter provides for administrative citations and administrative compliance order processes that are in addition to all other legal remedies, criminal or civil, which may be pursued by the City to address any violations of this Code or City ordinance.

B. These sections shall not supersede any other sections of this Code that address additional legal or administrative remedies available for City code violations; use of the administrative citation process shall be at the sole discretion of the City.

1.19.050 - Notice, method of service.

A. All notices required herein shall be served as provided as herein described unless otherwise specified.

B. Whenever a notice is required to be given under this Chapter, unless different provisions are otherwise specifically made, such notice may be given either by personal delivery to the person to be notified or by deposit in the United States Mail, in sealed envelope postage prepaid, addressed to such person to be notified at their last-known business or residence address as the same appears in the last equalized county assessment roll or to their records pertaining to the matter to which such notice is directed. Service by mail shall be deemed completed at the time of deposit in the United States Mail receptacle is made.

C. Where real property is involved, written notice shall also be mailed to the property owner as shown on the last equalized county assessment roll if different than the real property occupant.

D. Where personal service or service by mail upon the property owner cannot be made despite a diligent effort, a copy of the order shall be conspicuously posted at the property that is the subject of the order.

E. Where service is made as required herein, the failure of any person to receive any notice required under this section shall not affect the validity of any proceedings taken under this Chapter.
