Del Norte County Municipal Code Ch. 3.28 Administrative Costs Recovery Program

The sheriff is authorized and directed to establish an administra tion costs recovery program for the Del Norte County Jail pursuant to Penal Code Section 1209.

The program administered by the sheriff shall provide that the county may collect from a prisoner serving his sentence on weekends or similar periods during the week actual costs of such confinement provided, that the prisoner shall have the ability to pay as determined by the appropriate judge.

The board of supervisors shall establish by resolution, based upon evidence presented by the sheriff, a reasonable fee for each day of incarceration, not to exceed the actual costs to the county of such incarceration. This fee shall be reviewed by the board of supervisors on an annual basis, at which time the sheriff shall present evidence of the present actual cost to the county of such confinement.

The above described fee shall be collected from the prisoners upon completion of each weekly period of confinement until the entire sentence has been served.

All funds received by the sheriff under this program shall be deposited with the auditor-controller on the next available county working day and shall be directed into the county general fund.

The sheriff is authorized to make such further regulations and procedures as are necessary to implement this chapter.
