Davis Municipal Code Art. 30.04 Operation and Maintenance of Stormwater Control Measures

Verification of maintenance provisions is required for all control measures as specified in the state's Phase II Small MS4 General Permit (NPDES General Permit No. CAS000004). Verification, at a minimum, shall include a signed stormwater maintenance agreement and corresponding stormwater maintenance plan. The stormwater maintenance agreement shall state that the property owner accepts full responsibility for inspection and maintenance for the full term of the agreement or until the responsibility for maintenance is legally transferred. The property owner shall file the agreement with the city and record the agreement with the county. The responsible party named in the stormwater maintenance agreement shall maintain treatment control measures in good condition and promptly repair and restore all stormwater control measures, all necessary access routes, and appurtenances (grade surfaces, walls, drains, dams, structures, vegetation, erosion and sedimentation controls, and other protective devices). Such repairs or restoration and maintenance shall be undertaken in accordance with the stormwater maintenance agreement, and the stormwater maintenance plan.
