§ 22.16.010. Findings.¶
The city council of the City of Davis hereby finds and declares:
(a) The City of Davis is part of the federal air quality non-attainment area of the Sacramento region.
(b) Alternative fuel vehicles make a valuable contribution towards complying with federal and state ambient air quality standards.
(c) The California Vehicle Code provides for the regulation of vehicles and operators on the public streets and highways of this state.
(d) Public charging sites for electric vehicles allow electric vehicle operators to efficiently travel into and through the city and also contribute to their safety.
(e) The provision of preferential and restricted parking provides for the orderly use of limited public resources and is an incentive for increased ownership of electric vehicles.

§ 22.16.020. Scope.¶
The provisions of this article are intended to regulate the use of designated public electric vehicle parking spaces equipped with public electric vehicle chargers and car share vehicles in all public parking lots and city streets.

§ 22.16.030. Definitions.¶
Unless the context clearly requires otherwise, the following definitions shall apply with respect to the use of the following terms in this article:
Car share vehicle
is a motor vehicle that is shared by members of the public and paid for by the member using the vehicle. A car share vehicle must be designated as a car share vehicle by the city to be eligible to park in a car share vehicle parking space, as set forth herein.
Electric/car share vehicle parking space
is any legally marked parking space that identifies the use to be exclusively for an electric or car share vehicle.
Electric vehicle
is any motor vehicle that receives motive power from a battery or other storage device that receives electricity from an external source such as a charger.
Electric vehicle charger
is a device which permits the transfer of electric energy (by conductive or inductive means) to a battery or other storage device in an electric vehicle.
Non-electric vehicle
is any motor vehicle that does not meet the definition of "electric vehicle."
Public electric vehicle charger
is an electric vehicle charger that is owned and maintained by the city.

§ 22.16.040. Electric/car share vehicle parking spaces—Generally.¶
(a) Electric/car share vehicle parking spaces are reserved for parking electric or car share vehicles only as marked.
(b) Electric/car share vehicles may be parked in any space designated for public parking, subject to the restrictions that would apply to any other vehicle that would park in that space.

§ 22.16.050. Prohibitions.¶
(a) When a sign authorized under Section 22.16.070 provides notice that a space is a designated electric vehicle parking space, no person shall park or stand any non-electric motor vehicle in a designated electric vehicle parking space.
(b) Pursuant to Section 22.08.305, parking of any electric vehicle in any designated electric vehicle parking space between the hours of 8:00 a.m. and 6:00 p.m., excluding Sundays and holidays, shall be limited to a period of not more than four hours unless the electric vehicle is parked in a parking space that allows for an electric vehicle to be lawfully parked for more than four hours.
(c) When a sign authorized under Section 22.16.075 provides notice that a space is a designated car share vehicle parking space, no person shall park or stand any vehicle that is not a city designated car share vehicle in a designated car share vehicle parking space.

§ 22.16.060. Exception.¶
This article does not apply to parking provided in private parking lots for residential or commercial uses.

§ 22.16.070. Noticing of electric vehicle parking spaces.¶
Upon adoption by the city council of the ordinance codified in this article, the city engineer shall cause appropriate signs and marking to be placed in and around electric vehicle parking, spaces, indicating prominently thereon the parking regulations. The signs shall state that the parking space is reserved for electric vehicles, that an electric vehicle may only park in the space for four hours and that violators are subject to a fine and removal of their vehicle.

§ 22.16.075. Noticing of car share vehicle parking spaces.¶
Upon adoption by the city council of the ordinance codified in this article, the city engineer shall cause appropriate signs and marking to be placed in and around car share vehicle parking, spaces, indicating prominently thereon the parking regulations. The signs shall state that the parking space is reserved for car share vehicles, that a car share vehicle may only park in the space and that violators are subject to a fine and removal of their vehicle.

§ 22.16.080. Violations—Penalties.¶
(a) Violations of this article shall be punishable as infractions. Punishment shall be by a fine not to exceed the fine prescribed in accordance with Section 36900 of the California Government Code or successor legislation. Each day such violation is committed shall constitute a separate offense and shall be punishable as such.
(b) In addition to a fine, a person who has parked or left a vehicle standing upon a street, alley or city parking lot in violation of this article, is subject to having the vehicle removed from the street, alley, or city parking lot by any member of the police department authorized by the police chief in the manner and subject to the requirements of the Vehicle Code of the State of California.

§ 22.16.090. Regulations not exclusive.¶
The regulations contained in this article do not supersede or preclude the enforcement of any zoning regulation, noise regulation or any other regulation contained in this Code which may be applicable to any conduct regulated hereby.
