5-2.26 Definition. As used in this section:

Cardroom employee shall mean any person (1) who is connected with the operation or supervision of a cardroom or card table as a dealer or otherwise, except as a licensee, or as a member of the public lawfully playing or watching play thereat, (2) whose connection is for or with the person(s) who is or should be licensed to operate the cardroom, and (3) whose such activities are or are not volunteer, unpaid, or wholly, partly, regularly, or irregularly paid for or rewarded by cash, or other benefit, including being allowed to play free or at reduced rates; but is not any person whose such connection or activities are primarily to prepare, serve, clear away or clean beverages or foods, or to perform maintenance or custodial services.

5-2.27 Application.

a. An applicant for a cardroom work permit must be an individual human being who shall submit his verified written application to the Police Department, including:

    1. His criminal record, if any, including arrests as well as convictions;
    1. His fingerprints and photograph;
    1. A statement that he has resided in California for the one (1) year preceding the application; and
  1. Any other information that the Police Department may deem necessary to determine whether a work permit should be issued.

b. Fee. The applicant shall pay an application fee of fifty ($50.00) dollars, of which the Police Department shall refund any balance unused in processing the application if it is denied.

5-2.28 Action.

a. Cause. The Police Department may deny the initial or renewal application only if, in their opinion, the applicant was ever convicted of a felony, or of a misdemeanor involving theft or fraud or other dishonesty, or is not of good moral character.

b. Issue. Otherwise, the Police Department may issue a twelve (12) month nontransferable permit to the applicant with such conditions noted as the Chief of Police believes conducive to effectuating this section.

c. Fee. Each permittee shall immediately pay a nonrefundable nonproratable permit fee of fifty ($50.00) dollars.

d. Appeal. Appeals are governed by Section 1-8.

5-2.29 Renewal.

a. Application. Before the end of the eleventh month of the permit’s life, the permittee may apply to the Danville Police Department to renew it.

b. Form, Fee, Procedure. The procedure shall approximate that in subsections 5-2.19c, 5-2.27 and 5-2.28, except that:

  1. The application fee is twenty-five ($25.00) dollars, any unused remainder of which is refundable only if the renewal is denied;

  2. No fee is due for issuing the permit; and

  3. Action is by the Police Department rather than the Town Council.
